MEETING DATE: TUESDAY, JUNE 26, 1979 CITY HALL - DINNER KEY
A RESOLUTION EXPRESSING THE STRONG SUPPORT OF THE CITY COM-
MISSION FOR THE WYNWOOD ELDERLY PROGRAM AND BESEECHING REVEREND
JAMES L. GILMORE, JR., RECTOR OF THE HOLY CROSS EPISCOPAL CHURC
TO ALLOW THE SAID PROGRAM TO REMAIN AT THE CHURCH UNTIL NO-
VEMBER 1979, AS PREVIOUSLY AGREED, AT WHICH TIME THE PROGRAM IS
SCHEDULED TO BE MOVED TO THE LITTLE HAVANA COMMUNITY CENTER AND
DIRECTING THE CITY CLERK TO FORWARD COPIES OF THE HEREIN RESO-
LUTION TO THE REVEREND GILMORE AND TO THE VESTRY OF THE SAID
CHURCH.
A RESOLUTION EXTENDING THE CONTRACT PERIOD FOR THE METROPOLITAN
DADE COUNTY ELDERLY SERVICES DIVISION/IMPACT PROGRAM/ALLAPATTAH
ELDERLY SERVICES UNTIL JULY 30, 1979, AND ALLOCATING THE AMOUNT'
OF $2,500 TO FUND THE ADDITIONAL TIME PERIOD WITH MONIES FROM
FIFTH YEAR COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS
A MOTION TO PLACE PROPOSED CHARTER AMENDMENT NO. 1 ON THE
NOVEMBER 6, 1979 CITY OF MIAMI ELECTION BALLOT IDENTIFIED AS
FOLLOWS:
"IN ORDER TO PRESERVE THE CITY'S .ATUPAi: SCENIC BEAUTY, TO
GUARANTEE OPEN SPACES FOR LIGHT, AIR AND SIGNIFICANT VISUAL ACC-
ESS, AND TO PROTECT THE ECOLOTY OF THE WATERFRONT AND BISCAYNE
BAY AND THE MIAMI RIVER, ANYTHINC IN THIS CHARTER OR THE ORDIN-
ANCES OF THE CITY OF MIAMI TO THE CONTRARY NOTWITHSTANDING NEITH
THE CITY NOR ANY OF ITS AGENCIES SHALL ISSUE BUILDING FOR OR
PERMIT ANY SURFACT PARKING OR ENCLOSED STRUCTURE (.EXCEPT
STRUCTURES AT THE PORT OF MIAMI) LOCATED ON BISCAYNE BAY,
GOVERNMENT CUT, OR THE MIAMI RIVER FROM ITS MOUTH TO THE SOUTH.
MIAMI AVENUE BRIDGE:
1. WHICH IS NOT SET BACK AT LEAST 50 FEET FROM THE BULKHEAD
LINE OR SEAWALL WHICHEVER IS GREATER EXCEPT THAT WHERE THE DEPTH
OF THE LOT IS LESS THAN 150 FEET THE SETBACK SHALL BE 25% OF
THE LOT DEPTH. THE CITY AFTER PUBLIC HEARING MAY GRANT AN
EXCEPTION TO THIS SETBACK REQUIREMENT IF THE LANDOWNER OR THE
CITY DEDICATES A PERMANENT PUBLIC RIGHT-OF-WAY ALONG THE WATER-
FRONT NOT LESS THAN 25 FEET AVERAGE DEPTH AND AT NO POINT LESS
THAN 20 FEET IN WIDTH AND PROVIDES ACCEPTABLE LANDSCAPING AND
MAINTENANCE FOR SUCH RIGHT-OF-WAY; OR
2. WHICH AT GROUND LEVEL OBSTRUCTS THE PUBLIC's VIEW OF BISCAYN
BAY, GOVERNMENT CUT OR THE MIAMI RIVER BY OCCUPYING MORE THAN
75% OF THE WATER FRONTAGE OF EACH LOT OR TRACT ON WHICH THE
STRUCTURE IS TO BE BUILT. THE FRONTAGE SHALL BE COMPUTED BY A
STRAIGHT LINE CALCULATION MEASURED FROM THE MAJOR PUBLIC RIGHT-
OF-WAY. THE CITY IN ITS ZONING CODE MAY GRANT FLOOR AREAS RATIO
AND HEIGHT BONUSES FOR OBSERVING SUCH PROPERTY OCCUPANCY LIMITS"
A MOTION TO REFER BOTH PROPOSALS IDENTIFIED AS CHARTER AMENDMENT
NO. 1 AND CHARTER AMENDMENT NO. 2 TO THE PLANNING ADVISORY BOARD
ZONING BOARD, ENVIRONMENTAL PRESERVATION REVIEW BOARD, CITY
ADMINISTRATION, LAW DEPARTMENT AND WATERFRONT BOARD FOR STUDY
TO DETERMINE (1) IF ANY PROBLEMS EXIST IN THE PROPOSALS
(2) IF ANY INHERENT DANGERS EXIST IN THE PROPOSED AMENDMENTS-

AND REQUESTING THAT ALL OF THE AFOREMENTIONED BOARDS DELIBERATE
AND DEBATE THESE PROPOSED AMENDMENTS AND MAKE RECOMMENDATIONS AS
SOON AS POSSIBLE TO THE CITY COMMISSION
A MOTION DEFERRING CONSIDERATION OF APPLICATION FOR CHANGE OF
ZONING ON THE CORNER OF VIRGINIA AND OAK STPEETS FROM R-2 TO
C-2A IN ORDER THAT THE CITY OF MIAMI LAW DEPARTMENT CAN RESEARCH
LEGAL QUESTIONS POSED BY COMMISSIONER GORDON IN CONNECTION WITH
THIS APPLICATION
A MOTION REQUESTING THE PLANNING DEPARTMENT TO REVIEW PROCEDURES
CURRENTLY IN USE CONCERNING THE PROCESSING AND APPROVAL OF PLATS,
EXPRESSING THE UNHAPPINESS OF THE CITY COMMISSION WITH THE PRESENT
SYSTEM AND REQUESTING THE PLANNING DEPARTMENT TO SUBMIT THEIR
RECOMMENDATIONS FOR CHANGES IN THE -PROCEDURES
A MOTION TO ACCEPT AND MAKE PART OF THE PUBLIC RECORD, A LETTER
RECEIVED FROM JAMES A RYDER, CHAIRMAN OF THE BOARD, GOODWILL
INDUSTRIES INC., REQUESTING THAT THE CITY OF MIAMI BID ON THE
BISCAYNE ANNEX POST OFFICE FACILITY PRIOR TO JULY 11, 1979;
CONDITIONED UPON DELIVERY OF THE BID IN THE AMOUNT OF $2,250,000
TO THE CITY, THE FURNISHING OF 10% DEPOSIT TO BE FURNISHED TO
THE CITY BY GOODWILL INDUSTRIES AND ALL ADDITIONAL FUNDS TO BE
PAID BY GOODWILL INDUSTRIES, ADDITIONAL BID WILL BE 10% CASH
WITH BALANCE SECURED BY 2 YEAR PRIME RATE PURCHASE MONEY MORTGAGE
ACCEPTABLE TO THE POST OFFICE DEPARTMENT; ALL OF THE HEREIN
AGREEMENT BASED UPON RECEIPT OF A LEGAL OPINION FROM THE CITY
ATTORNEY THAT THE CITY OF MIAMI WILL INCUR NO RISKS, EXPENDITURES,
LIABILITY OF ANY KIND AND THAT THE CITY BE COMPLETELY INDEMNIFIED
IN CONNECTION WITH OUR DESIRE TO ASSIST GOODWILL INDUSTRIES IN
THE ACQUISITION OF THE BISCAYNE ANNEX POST OFFICE FACILITY.
