Attached for your consideration and proposed action during the June 26,
1979, Planning & Zoning Commission Meeting is a resolution accepting
the plat entitled: "Brickell Key. On Claughton Island - Section 1."
The developers of Claughton Island submitted an opinion of title which
contained inaccurate information at the beginning of this month. When
the error was detected, the developers were immediately notified that
a corrected opinion of title containing the proper legal description
of the property to, be platted must be submitted in order for the plat
to be submitted to the City Commission for approval. The required in-
formation was not received until Friday afternoon, June 22, 1979.
Since this development involves substantial amounts of money, and since
timing and scheduling are crucial, the developers have petitioned the
City to have the matter considered at the June 26, 1979 Commission Meeting.
While it is clearly understood that your five-day rule on items of le-
gislation to be considered will permit any member of the Commission to
request deferral, this plat approval is being submitted at the urgent
request of the developer and with the City Manager's recommendation.

The accompanying Plat entitled BRICKELL KEY ON CLAUGHTON ISLAND
SEC. ONE was prepared by Connell, Metcalf & Eddy, Inc. It .is in
correct form for submission to the City Commission and is forwarded
with a recommendation that it be approved.
PERTINENT INFORMATION REGARDING THE PLAT:
(1) The property platted is a subdivision:: of an unrecorded island in
Biscayne Bay, lying in Sections 6.and ;7,=Township 54S, Range 42 E,
and w11 consist of four (4)'tracts having a total area of
11.27- acres. It is zoned SPD-1.
(2) The location of the streets and the widths conform with the
standards of -the Department of Public _Works of the City of
Miami,.. Florida.'
As .certified to by David M. Mulvie, Registered Land Surveyor, this
plat complies with the plat filing laws of the State of Florida.
(4) By authority of Resolution No. ZB 104-79,adopted May 7, 1979,
the Plat was recommended for acceptance by the City Zoning Board
of Miami, Florida.
(5) The attached Certificate of Title Examination dated May 23,.1979,

SPECIAL EXCEPTIONS
6. Mineral and petroleum reservations -contained in those certain Deeds
from the Trustees of the Internal Improvement Fund filed on February.
5, 1920, in Deed Book 208 at Page 183, and filed on July 21, 1969,
under Clerk's File No. 69R-127031, respectively.
7. As -built survey prepared by Connell Metcalf & Eddy, Inc. and dated
January 23, 1978, indicates that the 'seaward face of the seawall
surrounding the subject premises lies slightly within the recorded
bulkhead line set forth in Plat Book 74, Page 3, Sheet 4. As a
• result, it appears that a small portion of the subject premises
lies outside said seaward face of the seawall and, therefore,
constitutes submerged land. Title to said portion of the subject
premises lying seaward of said seaward face of the seawall is not
insured.
NOTE: Said survey indicates that the acreage for the subject
premises computed by Garris in 1971 was 44.0183 acres and
that the acreage based upon the "as built" bulkhead line
is 43.8836 acres. This policy does not insure the accuracy
of the foregoing acreage computations.
8. The subject premises being artificially filled in land in what
was formerly navigable waters, it is subject to any and all
rights and easements for commerce, navigation, recreation and
fisheries of the United States Government arising by reason of
the United States Government's control over navigable waters.
Riparian rights, if any, are not insured.
