A RESOLUTION GRANTING APPROPRIATE EASEMENTS
ADJACENT TO THE SOUTHERLY PROPERTY LINE OF
CITY OF MIAMI OWNED PROPERTY ABUTTING THE
SOUTH RIGHT OF WAY LINE OF N.W. 20 STREET
BETWEEN N.W. 10 AVENUE AND N.W. 14 AVENUE,
TO THE MIAMI-DADE WATER AND SEWER AUTHORITY,
FOR SEWER PURPOSES; AND AUTHORIZING AND
DIRECTING THE CITY MANAGER. AND THE CITY
CLERK TO EXECUTE THE APPROPRIATE DOCUMENTS,
THEREFOR.
WHEREAS, the Miami -Dade Water and Sewer Authority, proposes to
construct'a 30-inch sanitary sewer force main between N.W. 26 Street
at N.W. 23 Avenue and N.W. 4 Street at.'N.W. North River Drive; and
WHEREAS-, the most feasible route for said force main includes a
strip of land ownedby. the Cityof Miami, adjacent to the southerly.
property line of that property abutting the. south right of way line
of N.W. 20 Streetbetween N.W. 10 Avenue' and, N.W. 14 Avenue; and

WHEREAS, 'a portion -of said, strip of 'land is presently
by various underground utility:installations; and
WHEREAS, the Miami -Dade Water and; Sewer Authority'has demon-
strated,that said sanitary.: sewer force main route is the most
feasible and cost effective' -rouge; and
WHEREAS, the Miami -Dade Water and. Sewer"Authority has requested
that the City of Miami;'designate said strip of land 'as a 10-foot
wide permanent sewer. easement; and
WHEREAS, the Miami -Dade Water and Sewer Authority has requested
an additional 10-foot wide temporary; construction. easement noEtIN

WHEREAS, the Miami -Dade Water, and Sewer: Authority bylT E M N O..
ResolutionR-42-79 approved January 9, 1979 has acquired approval
from Metropolitan Dade Countyfor use as an easement that portion of
land contained in aforesaid strip. of land, previously granted as a
permanent -'easement to' Metropolitan Dade County as authorized by City
of Miami Resolution To. 31361 dated November 4, 1959; and
WHEREAS, a Grant of Easement for sewer purposes has been pre-
pared and said: Grant; of Easement has been reviewed by the City of
Miami Department of Law;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION -OF THE
OF MIAMI, FLORIDA:
Section 1. The Miami -Dade Water and Sewer Authority has re-
quested that the City of Miami grant a 10-foot widepermanent sewer
easement and 'an additional' 10-foot wide temporary construction ease-
ment northerly of and adjacent to the aforesaid permanent easement
on City owned property to the Miami -Dade Water and Sewer Authority
for purposes of laying and constructing a 30-inch sanitary sewer
force: main, -and said Grant of Easement has been prepared and shown
on City of Miami-Misc.''Sketches No. 17-NW-1554 and 17-NW-1555.

demonstrated that the route now proposed by the Miami -Dade Water
and Sewer Authority is the most feasible and `cost effective route.
Section 3•_ The Grant of Easement for sewer purposes from the

in' the Southerly .35,feet'more or less of that property adjacent to
the southerly_property,line of that property owned by the City of
Miami abutting the south right of way line of N.W. 20 Street between

"Easement Description" attached hereto and made a part hereof as if
fully incorporated herein, be, and the same is, hereby approved, and

Resolution, Grant of Easement
It is recommended that appropriate easements
(a 10-foot, wide temporary construction easement.
and a l0-foot wide permanent easement) located -
within the southerly 35 feet of City -owned
property along N.W. 20 Street between N.W. 10:
Avenue and N.W. 14 Avenue, be granted to the
Miami-Dade Water and Sewer Authority for the
construction of a 30-inch sanitary sewer force:
main as per the attached resolution.
The Miami -Dade Water and Sewer Authority plans to construct a 30-inch.
sanitary sewer force main between the intersection of N.W. 26 Street
and N.W. -,, 23 Avenue and `the `-intersection of N.W. 4`' Street and N.W.
North River Drive.
The routing of this force main includes a strip of land adjacent to
the southerly property line of City -owned property abutting the south
right of way line of N.W.. 20 Street between N.W. 10 Avenue and N.W.
14 Avenue.
After a review of' several alternate. routes by this department, the
Miami -Dade Water and Sewer. Authority, has demonstrated; that the most_
feasible route for the proposed;30-inch force ma in is, through the'
aforesaid strip of land owned by the. City of,Miami, and a Grant of
Easement has, been prepared for same.
As just compensation for this easements the Miami -Dade Water and Sewer
Authority has `agreed to construct water main improvement's°estimatedat
$1,000,000 implementing the fire protection Priority One System
Improvernents, prepared by the Fire Department.

THIS INDENTURE, made this day of

State of Florida, party of the first part, and the MIAMI-DADE
WATER AND SEWER AUTHORITY; an agency and instrumentality of' the
County of Dade, a political subdivision organized under the Laws

to the Heavy Equipment Facility and associated parking area adjacent
the above easement and owned by the party of the first part.
The party of the first part does hereby fully warranty that it
has good title to the above described proprty and that it has
full power and authority to grarit this easement.
Should the aboveeasement be abandoned or discontinued by law
or otherwise, the said easement shall cease and revert with the
right of immediate possession and right of entry to the party of
the first part and its successors in interest.

Implementation of Priority One
Fire Flow Improvements
Dear Mr. Grimm:'
On Friday, May 25, 1979, a meeting was held at the. City of Miami Public Works
Department. _Those attendingwere Capt. Teems andLt. Kickasola of the. Miami
Fire Department, ;Messrs. Cather and Kay of. the Miami Public Works Department;;
and Messrs. towgill, Rittenhouse and Ms. Palenzuela of the Miami -Dade Water
and Sewer. Authority. The purpose of the meeting was to clarify, our intentions
to implement the fire protection Priority One System Improvements, prepared
by the Fire Department (Copy attached).
It was confirmed at this meeting that the Priority One System Improvements and
the listing presented by us.at that time were one and the same. We arenow
proceeding with design of the system so that construction of the Priority One
System Improvements will be completed within the next two years.
The attending representatives of the.City's Fire and Public Works Departments
were agreeable to our proposal and schedule, as set forth. If you have any
questions, please call me.
