A RESOLUTION ACCEPTING THE BID OF ANDY
FRAIN-FLORIDA, INC. FOR FURNISHING CROWD
CONTROL SERVICES FOR THE ORANGE BOWL
STADIUM, AS REQUIRED; AND AUTHORIZING
THE CITY MANAGER TO ENTER INTO AN AP-
PROPI ATE AGREEMENT BETWEEN THE CITY OF
MIAMI AND ANDY FRAIN-FLORIDA, INC. FOR
PROVIDING SAID SERVICE IN ACCORDANCE
WITH THE TERMS OF THE BID, WITH FUNDS THEREFOR
ALLOCATED FROM THE ORANGE BOWL OPERATING BUDGET.
WHEREAS, pursuant to public notice, sealed bids D C/5

services, e.g., ushers, ticket sellers, ticket takers, and r.
rri supervisors, at the Orange Boyd Stadium; and
WHEREAS, the Department ofStadiums and . Marinas
received -bids . frOm two firms for providing this ' serv?_ce; and
•' WHEREAS,it was determined that the .bid of Andy Frain -Florida, Inc. was the, most, • advantageous to .the, City; and
WHEREAS, the Department of Stadiums and., Mari n.as:....,,

as required for, Orange Bowl events.

AGREEMENT"
THIS AGREEMENTentered into this dayof
1979, by and between the CITY OF MIAMI;
a municipal corporation of the State of' Florida, hereinafter
referred to as "the City", and ANDY FRAIN-FLORIDA, INC..
hereinafter referred to as "the Contractor".
WITNESSETH
WHEREAS, the Commission of ;the.City of Miami,
by• Resolution No. passed' and adopted on
19.79, authorized the City Manager'`to'enter'into an -agreement
•with "Andy.Frn-
aiFlorida, Inc., for furnishing of crowd control
services during events held'at the Orange: Bowl.Stadium when
the City is •required •to'••furnish crowd:control.
NOW 'THEREFORE, in consideration of;°the-'covenants
and affirmations as herein set forth,
agree as follows:
I. TERM:

J. The Contractor shall ensure' that personnel will -report:
to the'Orange Bowl Stadium -at least two hours before
scheduled beginning.of any event, and will further.ensurethat
`the stadium is secured after all patrons have left' the, event.
K. 'The Contractor shall not, at any time during the term`
this. Agreement,sublet any part of the Agreement`or assign any
portion or part of the Agreement, except upon written permission;
of the City Commission or its properly designated officials.
Contractor shall provide the City with a typed listing_
.of names of all'personnel' furnished for each eventand
."signature of employee must be affixed beside or above printed
name. Said list will be required before payment by City".

M. The City Stadiums Manager shall stipulate at lest 48
hours prior to game time the number of personnel needed for
the event, Failure to furnish the number stipulated in
agreement will be cause for cancellation of Agreement by Cl.ty.
IV. THE CITY OF MIAMI COVENANTS WITH THE CONTRACTOR THAT:
A. The City of Miami shall establish the standards whl.ch
are to be maintained for the services rendered by the contractor.
B. The City, through its proper officials, shall have the
right and authority to prescribe, in writing, any additional
rulesand regulati_ons pertaining to crowd control; reserving
also the right to cancel this Agreement for violation of rules
and regulations by the Contractor or his employees.
C. The City agrees to make payments to the Coritractorin
accordance with the consi.deration a.loove set forth, within
30 days after each event.
D. The City agrees to provide the Contractor with adequate
dressing room facilities.

E. The City agrees to pay the Contractor.ln full in the

VI. HOLD HARMLESS. PROVISION:
