A RESOLUTION ACCEPTING 'CITE BID OF E-SYSTEMS, INC. FOR FUR-
NISHING A MOBILE INFORMATION SYSTEM AND EQUIPMENT FOR THE
DEPARTMENT OF FIRE AT A TOTAL COST OF..$532,854.00; ALLOCATING
FUNDS FROM TIIE 1976 FIRE FIGHTING, FIRE PREVENTION AND RESCUE
FACILITIES BOND PROGRAM, AUTHORIZING THE CITY MANAGER TO
EXECUTE A CONTRACT FOR THE "PURCHASE `OF THIS EQUIPMENT.
WHEREAS, pursuant to public notice, sealed bids were received'
April 10, 1979 for the furnishing of a Mobile Information' System and
Equipment for the Department of Fire; and
WHEREAS, invitations were mailed to nine potential suppliers an
one bid was received; and
WiIEREAS, funds for this purchase are available in the 1976 Fire
Fighting, Fire Prevention, and Rescue Facilities Bond Program; and
WHEREAS, this equipment will be used by the Department of Fire
for thepurpose of Fire Suppression, Fire. Rescue, Dispatch, Fire
and Fire Administration; and
Prevention
WHEREAS, the City Manager and the Department of Fire recommend
that the bid received from E-Systems, Inc. be accepted as the mos
advantage.ous bid to the City;
NOW, THEREFORE,

most advantageous bid as received from E-Systems, Inc. for furnishing. a Mobile

This is in response to your recent request for a Legal Opinion on
essentially. the. following:,
WHETHER THE CITY CAN NEGOTIATE WITH A BIDDER TO ELIMINATE
UNNECESSARY COSTS?
The answer is in the negative.
The pertinent facts are as follows:
On April 10, 1979, the City received one response to an
advertisement for bids on a mobil information system. In
the course of a post -bid meeting with the sole bidder, an
item by item analysis of the bid was conducted, disclosing,
that engineering costs were included in the bid package,
though not requested by the Fire Department.
Generally, competitive bidding law requires that a bid conform'to or
mirror the Request for Proposal (RFP),.unless said RFP calls for alternative
Competitive.bidding law also prohibits public authorities from.negotiat-
:;ing"with successful bidders to -alter the scope or the price"of:a project;.
after bids,; are received,, unless' the public' authority reserved the power to
omit any_portion of the -project 'in the bid advertisement., McQuillin Mun.

Under the above facts and authority, the. City has the option of rejecting
the entire bid and re -advertise and re -bid the project, or the City can
simply reject the non•-conformine'portion(s) of>the`proiect. i.e. the engineer-
in costs.
