HomeMy WebLinkAboutO-0897500+ • ORDINANCE NO. 8975 0 AN ORDINANCE AMENDING ORDINANCE NO. 6871 THE COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF MIAMI, BY CHANGING THE ZONING CLASSIFICATION OF LOT 4, LESS THE SOUTHERLY 5 FEET THEREOF, BLOCK 5; KIRKLAND HEIGHTS (3-214) BEING 129 S.W. 36TH COURT FROM R-2 (TWO FAMILY) TO C-4 (GENEIAL COMI4ERCIAL) , AND BY MAKING THE NECESSARY CHANGES IN THE ZONING DISTRICT MAP MADE A PART 0- THE SAID ORDINANCE NO. 6871 BY REFERENCE AND DES- CRIPTION IN ARTICLE III, SECTION 2 THEREOF; BY REPEALING ALL ORDINANCES, CODE SECTIONS, OR PARTS THEREOF IN CONFLICT; AND CONTAINING A SEVERABILITY PROVISION. WHEREAS, the Miami Zoning Board at its meeting of May 21, 1979, Item No. 3, following an advertised hearing, adopted Resolution No. ZB 111-79 by a 5 to 2 vote recommending denial of change of zoning classification as hereinafter set forth; and WHEREAS, the City Commission notwithstanding the re- commendation of denial by the Miami Zoning Board, and after careful consideration and due deliberation of this matter, deems it advisable and in the best interest of the City of Miami and its inhabitants to amend said Ordinance as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 6871, the Comprehensive Zoning Ordinance for the City of Miami be, and the same is hereby amended by changing the zoning classification of Lot 4, less the Southerly 5 feet thereof, Block 5, KIRKLAND HEIGHTS (3-214) being 129 S.W. 36th C^urt from R-2 (Two -Family) to C-4 (General Commercial); and by making the necessary changes in the Zoning District Map made a part of said Ordinance No. 6871 by reference and description in Article III, Section 2, thereof. 11111 1 11 111II111111111g111111 I r9?I'" Section 2. That all laws or parts of laws innconflict, herewith be, and the same are hereby repealed insofar as they are in conflict. Section 3. Should any part or provision of this Ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the Ordinance as a whole.
