TO ORDINANQ NO.8719 ORDINANCE NO. 8972`—r"--' r� AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 8719 ADOPTED OCTOBER 26, 1977, THE SUMMARY GRANT APPROPRIATION ORDINANCE, AE AMENDED BY ESTABLISH- ING A NEW TRUST AND AGENCY FUND ENTf"+LED:"BLUE LAGOON PARK ACQUISITION" AND APPROPRIATING FUNDS FOR THE PURPOSE OF SAME IN THE AMOUNT OF $688,410; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND DISPENSING WITH THE REQUIRE- MENT OF RV DING SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION. WHEREAS, the City Commission adopted Ordinance No. 8719 on October 26, 1977, establishing resources and appropriations for grant funds anticipated by the City of Miami, Florida, and for corresponding City matching funds; and WHEREAS, the Florida Department of Natural Resources, on behalf of the U.S.. Department of Interior, has recommended that the City of Miami be granted an award of $333,410 of Federal Land and Water Conservation monies to assist in the purchase of approximately 3.4 acres of land along the southern shoreline of Tamiami Canal and Blue Lagoon for development of a neighborhood park; and WHEREAS, the Florida Department of Natural Resources requires a dollar -for -dollar cash match for the aforementioned grant award; and WHEREAS, the additional sum of $21,590 is required to cover the costs of legal fees and administrative expenses related to the acquisition of the land, thus increasing the City of Miami's contribution to $355,000; WHEREAS, a sum of $355,000 for the implementation of the above program has been identified within the Parks for People Bond fund and can be transferred as follows: (1) Remain- ing Park District VIII Improvements--$90,000; (2) West End Park--$65,000; and (3) Bayfront Park Landfill--$200,000; and WHEREAS, a Trust and Agency Fund is required to identify this capital project as funded in part by a grant and the Capital Improvement Appropriation Ordinance (8716) will be amended to incorporate this project within the Capital Projects Fund; 0 0 APPROPRIATION: Blue Lagoon Park Acquisition 0 NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 0 Section 1. Section 1 of Ordinance No. 8719, adopted t October 26, 1977, as amended, is hereby further amended innthe 0 0 1/ following particulars: "Section 1. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. 1/ Underscored words and/or figures constitute the amendment proposed. Grassie City Manager Carl Kern, Director Department of Parks r") e-- 0 3 July 11, 1979 Blue Lagoon Park Acquisition: Ordinance Amendments to Provide City Matching Funds .=F�::EY•�.:5 0 There is a need for additional neighborhood parks in the Flagami area, as indicated in the Wallace-McHarg Park Deficiency Study of 1976 (see map 1). Since the study was completed, the Flagami area has sustained a substantial population increase of young married couples with children (see map 2), thus further aggravating the need for addi- tional neighborhood parks. The population increase is associated with much residential development which is reducing the availability of vacant land and increasing land acquisition costs, thereby necessitating the need to act quickly. The proposed park site to be acquired, "Blue Lagoo+i," is located on NW 7th Street between 51st and 52nd Avenues (see map 3); it has many recreational attributes and potential: significant flora (e.g. large stand of royal palms) " significant fauna (e.g. West Indian manatee - endangered species) fresh water access for boating fresh water access for fishing adequate size for: play, parking, picnicking The State of Florida's Department of Natural Resources thought the Blue Lagoon Park Acquisition Project was so worthwhile that they have recommended that Federal Land and Water Conservation Funds be approved for the project. In`adclifion, Dade -County Planning and the Regional Planning Council have endorsed the project in the A-95 review process. Currently we are waiting for the official confirmation of the Land and Water Conservation Fund Grant Award. The Grant is for 50% reimbursement of acquisition costs and the balance has to be supplied by the City of Miami. The attached ordinance amend- ments are to provide the necessary matching funds of $355,000 from the Parks for People Bond Fund.
