TO ORDINANCE NO. 8719 0 ORDINANCE NO. 8971 AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 8719 ADOPTED OCTOBER 26, 1977, THE SUMMARY GRANT APPROPRIATIONS ORDINANCE, AS AMENDED; BY ESTABLISHING A NEW TRUST AND AGENCY FUND ENTITLED: "NOGUCHI EARTH SCULPTURE IN BAYFRONT PARK", AND APPROPRIATING FUNDS FOR THE PURPOSE OF SAME IN THE AMOUNT OF $100,000; CON- TAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND DISPENSING WITH THE REQUIREMENT OF READING SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION. WHEREAS, the City Commission adopted Ordinance No. 8719 on October 26, 1977, establishing resources and appropriations for grant funds anticipated by the City of Miami, Florida, and for corresponding City matching funds; and WHEREAS, the City of Miami and the Downtown Development Authority jointly submitted a grant application to the National Endowment for the Arts requesting $50,000 to engage the services of Isamu Noguchi, an environmental artist, to design an earth sculpture; and WHEREAS, said earth sculpture would provide a piece of sculpture, an amphitheater, and a fountain on the bandshell site; and WHEREAS, the grant application has received favorable review by the National Endowment for the Arts; and WHEREAS, upon approval of the grant award, a phased contract(s) will be entered into with Isamu Noguchi to cover project design activities such as site analysis, potential uses, conceptual plan, design narrative, sketches, recommended materials, cost estimates, a model, detailed design plans and construction drawings, specifications, legal documents, and construction supervision during implementation; and WHEREAS, a sum of $50,000 has been identified within the Parks for People Bond Program from the Capital Project entitled: "Bicentennial (FEC) Park. Acquisition and Develop- ment" which includes funds for the development of Bayfront Park; and WHEREAS, a Trust and Agency Fund is required to identify this capital project as funded in part by a grant and the Capital Improvement Appropriations Ordinance (8716) will be amended to incorporate this project within the Capital Projects Fund; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 1 of Ordinance No. 8719, adopted October 26, 1977, as amended, is hereby further amended in the following parti.culars:1/ "Section 1. The Following Trust and Agency Funds are hereby established and resources are hereby appropriated as described herein: * FUND TITLE Noguchi Earth Sculpture in Bayfront Park RESOURCES: National Endowment for the Arts --Visual Arts 1972 Parks for People Bond Program APPROPRIATION: Noguchi Earth Sculpture in Bayfront Park * $50,000 $50,000 $100,000 $100,000" Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. 1/ Underscored words and/or figures constitute the amendment proposed.
