HomeMy WebLinkAboutO-08978RFC/rb 6/25/79 110 ORDINANCE NO. 8978 AN ORDINANCE AMENDING SECTION 5 OF ORDINANCE NO. 6145, ADOPTED MARCH 19, 1958, AS AMENDED, WHICH PROVIDES FEES FOR BUILDING, PLUMBING, ELECTRICAL, MECHANICAL (INCLUDING BOILER AND ELEVATOR) INSPECTION, PERMIT AND CERTIFICATE FEES, BY SUBSTITUTING NEW FEE SCHEDULES IN SAID SECTION 5 TO COVER THE INCREASED OPERA- TIONAL COST PRIMARILY FOR THE ENFORCEMENT OF THE SOUTH FLORIDA BUILDING CODE; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, it is essential that the fees as provided herein be increased; and WHEREAS, the City Manager recommends that in order to provide this much needed service for the operation of the municipality that the fees as herein provided be increased: NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 5 of Ordinance No. 6145, adopted March 19, 1958, as amended, which provides fees for building, plumbing, elec- trical and mechanical (including boiler and elevator) inspection, permit and certificate fees is hereby further amended by substituting new increased fee schedules therein to cover the increased opera- tional cost primarily for the enforcement of the South Florida Building Code with the newly amended Section 5 reading as follows: "SECTION 5 - FEE SCHEDULE: a. FEE FOR WORK WITHOUT PERMIT When work for which a permit is required is commenced prior to obtaining of a permit, a fee four (4) times that specified herein shall be paid, but in no event shall such fee be less than $25. The payment of such fee shall not relieve any person, firm or corporation from fully complying with all of the requirements of all applicable regulations and codes, nor shall it relieve them from being subject to any of the penalties therein. The fee requirement shall be applicable to all divisions of the Building and Zoning Inspection Department. MINIMUM FEE $25 77, b.. REINSPECTION FEES (1) When extra inspection trips are necessary due to (a) wrong address being given on call for inspection; (b) prior rejection of work due to faulty construction; (c) work not being ready for inspection at time specified; (d) failure to call for final or other inspections; (e) required corrections not being made at time specified; (f) work not completed when final inspection called, a fee equal to 10% of the original permit fee or $25, whichever is greater, shall be charged $25 The payment of reinspection fees may be required before any further permits will be issued to the person or firm owing same, and further inspections may he refused until payment of reinspection fees has been made. (2) INSPECTION OF EXISTING BUILDINGS FEE Reinspection of existing buildings by all divisions to determine compliance with the South Florida Building Code. the Comprehensive Zoning Ordinance and other applicable ordinances (but not an annual inspection as required by Section 305.1(d) of the South Florida Building Code ) Buildings up to two (2) stories and not exceeding 20,000 _ square feet - per Division $15 Each additional 1,000 square feet or fraction thereof - per Division $ 1 Additional for each story over two (2) stories - per division For each floor (for buildings over two (2) stories) over 10,000 square feet additional per 1,000 square feet - per division (3) RECERTIFICATION OF PLANS FEE When plans are lost by the owner or contractor, a recertification fee is required to recertify a new set of plans $ 5 $ Per 100 square feet or per $1,000.00 where square footage $ 2 is not applicable (4) DRY RUN FEE Review of preliminary plans prior to application for building permit 1 Per 100 square feet $ 2 Per $1,000.00 (where square footage is not applicable) $ 2 80% of total amount will be credited to the Building Permit when issued. No refunds will be allowed. 2 8978 4 c. REFUNDS, TIME LIMITATION, REVOCATION, ETC. The fees charged pursuant to this ordinance,provided the same are for a permit required by Section 301.1 of the South Florida Building Code, may be refunded by the Director of the Building & Zoning Inspection Department, subject to the following: (1) No refund shall be made where any work has commenced except where duplicate permits are issued for the same work, in which case a refund in accordance with Item 4 hereof may be granted to the original permit holder providing that the duplicate permits were issued within ninety (90) days of each other and request for refund is received within ninety (90) days of the issuance of the latter permit. (2) No refunds shall be made where permits have become void as provided by Paragraph 304.3(a) of the South Florida Building Code. (3) No refunds shall be made on permit fees of $6 or less. (4) Refunds on permits or any item thereon where fees are over $6 will be refundable on a basis of seventy percent (70%) of the balance over $6, such refunds to be made to the closest dollar. .'(5) Full refunds may be granted to a permit holder whose permit is cancelled by owner authorization where work has com- menced and such owner selects a second contractor to com- plete the work. The second contractor shall pay a full fee to complete the work unless the first contractor waives his opportunity to a refund in writing, in which case the second contractor is entitled to a permit to cover the same work on a "no charge" basis. (6) A full refund may be granted to a permit holder who takes out a permit covering work outside the jurisdictional inspection area, or if permit is cancelled by the Depart- ment within 90 days with no work being done. d. BUILDING PERMIT FEES: (Fees listed here do not include plumbing, electrical, or mechanical installations, or use and occupancy fees). Proposed Ordinance Amending Permit Fee Schedule - Ordinance No. 8688 Attached is a proposed ordinance recommending increases in some of the present permit fees for building construction. These increases are required due to the increase in operational cost. Since the enactment of the last fee schedule on October 10, 1977 there have been several increases in salary, cost of vehicle operation and general overhead, including purchasing of required forms and other office supplies (approximately 18% increase). In the basic Building Permit Fees not all fees are recommended raised, but only those that we feel do not cover cost of operation. We have expanded some fees so that actual fee for single family and duplex remains the same, but a higher fee will be charged for more complex buildings requiring more time in plan reviewing and the inspection of construction. The double fee for construction without permit is recommended changed to four (4) times the normal fee, not only to cover our cost for the time spent to investigate, but to try to discourage illegal construction which is a continuing problem. Electrical Permit Fees have been raised approximately 10%. Mechanical Permit Fees were not raised sufficiently in 1977 and therefore have been increased approximately 20%. Plumbing Permit Fees have been left substantially the sameaccept for one or two to correct discrepancies in charges. We request that this be placed on July 11, 1979 Commission Agenda for first reading, and July 23, 1979 for second reading so that the new fee schedule will be in effect before the beginning of the new fiscal year.
