AMENDMENT NO. 28 TO ORDINANCE NO. 8858

AN EMERGENCY ORDINANCE AMENDING SECTIONS 5 AND 6 OF
ORDINANCE NO. 8858, ADOPTED SEPTEMBER 28, 1978, THE
ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR
ENDING SEPTEMBER 30, 1979, AS AMENDED; BY INCREASING THE
APPROPRIATION FOR THE PENSION TRUST AND AGENCY FUND IN
AN AMOUNT OF $100,000 FROM THE 1978 FUND BALANCE FOR
PENSION, TO OFFSET CHARGES AGAINST 1978-79 APPROPRIATIONS
FOR PROFESSIONAL SERVICES RECEIVED IN 1977-i8; CONTAINING
A REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 8858 on September
28, 1978, establishing revenues and appropriations for the City of Miami,
Florida, for the fiscal year ending September 30, 1979; and
WHEREAS, certain charges for professional services received in
fiscal year 1977-78 were billed after the close of that fiscal year; and
WHEREAS, funds for said charges were not encumbered in fiscal year
1977-78; and
WHEREAS, an amount of $100,000 is required to offset said charges
made against the 1978-79 Pension appropriations; and
WHEREAS, said funds are available from the 1977-78 fund balance for
Pension and $100,000 can be appropriated for the aforementioned purpose;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. Sections 5 and 6 of Ordinance No. 8858, adopted Sep-
tember 28, 1978, as amended, are hereby further amended in the following
particulars:2J

and/or figures constitute the amended proposed. The remaining provisions
are now in effect and remain unchanged. Asterisks indicate omitted and
unchanged material. All figures are rounded to the next dollar.

Section 2. The appropriation of $100,000 from 1977-78 Pension
Fund Balance as given herein is required to offset charges against the 1978-79
appropriations for 1977-78 professional services.
Section 3. All ordinances or parts of ordinances insofar as they
are inconsistent or in conflict with the provisions of this ordinance are
hereby repealed.
Section 4. If any section, part of section, paragraph, clause,
phrase, or word of this ordinance is declared invalid, the remaining pro-
visions of this ordinance shall not be affected.
Section 5. This ordinance is hereby declared to be an emergency
measure on the grounds of urgent public need for the preservation of peace,
health, safety, and property of the City of Miami, and upon the further ground
of the necessity to make the required and necessary payments to its employees
and officers, payment of interest and principal on its debts, necessary and
required purchases of goods and supplies, and to generally carry on the func-
tions and duties of its municipal affairs.

Section 6. The requirement of reading this ordinance on two sep-
arate days is hereby dispensed with by a vote of not less than four -fifths of
the members of the Commission.

Proposed Emergency Ordinance:.
Pension Trust and Agency Account -
Professional Services Deficit
A recent report concerning the operating accounts for the Pension Trust and
Agency Fund has identified a deficit of $100,000 for professional services.
This deficit is primarily attributable to accounting practices that
charged professional services received in fiscal year 1977-78 to the
1978-79 Pension appropriation.
The attached proposed emergency ordinance will offset the deficit in the
1978-79 appropriation by appropriating $100,000 from the Fiscal Year 1978
Pension Fund Retained Earnings Account. In the future these monies will be
encumbered in order to avoid such problems when billing is made after the
close of the fiscal year.
This ordinance has been prepared as an emergency measure for the
September 27, 1979 City Commission meeting in order to complete this trans-
action in the current budget year.
