HomeMy WebLinkAboutO-08985r- ORDINANCE NO. 8 9 8 5 �1 AN ORDINANCE AMENDING SUBSECTION 2-24.1(2) AND SUBSECTION 17-26(a) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY ESTABLISHING AN ANNUAL FIRE SAFETY INSPEC- TION PROGRAM TO BE CONDUCTED BY THE FIRE DEPARTMENT FOR BUILDINGS AND PREMISES, EXCEPT THE INTERIORS OF DWELLINGS, AND PROVIDING FOR THE ISSUANCE OF CERTIFICATES OF INSPECTION AND ESTABLISHING A SCHEDULE OF FEES THEREFOR; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Manager and the Director of the Miami Fire Department recommend that an Annual Fire Safety Inspection Program and "Fee Schedule be established; and WHEREAS, the City of Miami Fire Department, as part of its continuing efforts in fire prevention activities and achieve- ment of the fire safety inspection goals, as outlined in the Miami Fire Protection Rescue, and Emergency Services Master Plan 1977-87, is recommending expansion of the scope of its fire safety inspec- tions; and WHEREAS, the goal of an annual fire inspection of all commer- cial properties can be realized by adoption of this proposed ordi- nance; and WHEREAS, this ordinance will provide the Fire Department with the authority to inspect commercial properties on an annual basis and issue a Certificate of Inspection; and WHEREAS, the Program will be coordinated by the Fire Preven- tion Bureau, utilizing manpower resources of the Bureau and the Firefighting Division; and WHEREAS, the proposed fee schedule will allow for reimburse- ment of approximately 17% of the total cost of the Fire Department's inspection activities; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 1 Section 1. Subsection 2-24.1(2) of the Code of the City of Miami, Florida, as amended, is hereby further amended in the 1/ following particulars: "Sec. 2-24.1. Zoning certificate of use required; annual reinspection of buildings and premises; fees for inspections and issuance of certificates. * (2) Annual reinspection of buildings and premises. (a) Each existing use and/or premises shall be inspected annually ky the building and zoning inspection department to determine that it complies with the provisions of the appli- cable ordinances and regulations other than the provisions of chapter 633, Florida Statutes and chapter 17 of this code. * * " Section 2. Subsection 17-26(a) of the Code of the City of Miami, Florida, as amended, is hereby further amended in the following par- t/ ticulars: "Sec. 17-26. Inspection of buildings and premises. (a) It shall be the duty of the director of the department of fire to inspect, or cause to be inspected by the bureau of fire prevention, or by the fire department officers or, members, all buildings andpremises, except the interiors of dwellings, annually. or as often as may be necessary for the purpose of ascertaining and causing to be corrected any conditions likely to cause fire or to endanger life from fire, or for the pur- pose of enforcing the provisions of chapter 633, Florida Statutes. The assessment for the annual inspection and issuance of a certificate of inspection is as follows: 1. Apartment Building - three (3) to twelve (12) units $10.00 .Apartment Building_-_thirteen,_(I ,to fifty (50) dwelling units 25.00 $$25.00.
