ORDINANCE AMENDING SECTION 33-199 (USES
PERMITTED IN RU-1 DISTRICT) OF THE CODE OF
METROPOLITAN DADE COUNTY, FLORIDA, BY ADDING
THERETO SUB -PARAGRAPH (9) AND ADDING AS A
PERMITTED USE FAMILY DAY CARE AND AFTER
SCHOOL CARE FOR CHILDREN; PROVIDING THAT THE
TOTAL NUMBER OF CHILDREN LIVING ON THE
PREMISES DOES NOT EXCEED FIVE (5) IN NUMBER
INCLUDING THE CHILDREN OF THE RESIDENT
FAMILY; PROVIDING THAT THE AGE OF SUCH
CHILDREN DOES NOT EXCEED ELEVEN (11);
PROVIDING THAT APPROVAL IS FIRST SECURED
FROM THE HEALTH AND FIRE DEPARTMENTS AND
FROM THE FLORIDA DEPARTMENT OF HEALTH AND
REHABILITATIVE SERVICES; PROVIDING COMPLIANCE
WITH EDUCATIONAL AND CHILD CARE FACILITY
REQUIREMENTS OF THE CODE; REQUIRING A
CERTIFICATE OF OCCUPANCY; PROVIDING SEVERABILITY;
PROVIDING INCLUSION IN THE CODE; AND PROVIDING
AN EFFECTIVE DATE
WHEREAS, this Board finds that family day care centers
are needed in RU-1 districts in order to serve the needs of
WHEREAS, thisBoard finds that economic conditions exist
whereby there is an ever-increasing need to provide family
day care centers in close proximity to residential districts;
and
WHEREAS, this Board finds that permitting family day
care centers as a permitted use, subject to specified safe-
guards, in an RU-1 district is in furtherance of the public
health, safety and welfare,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD or COUNTY
COMMISSIONERS OF DADE COUNTY, FLORIDA:
Section 1. Section 33-199 of the Code of Metropolitan
Dade county, Florida, is amended by adding thereto sub-

paragraph (9), to read as follows:

Sec. 33-199. Uses --Permitted.
No land, body of water and/or structure shall be
used or permitted to be used and no structure shall be
hereafter erected, constructed, moved, reconstructed,
structurally altered or maintained for any purpose in
a RU-1 district which is designed, arranged or
intended to be used or occupied for any purpose other
than the following, unless otherwise specifically
provided herein.
(9) Notwithstanding anything to the contrary
in this Code, family day care and after school care
for children is permitted upon compliance with the
following conditions:
(a)
That the total number of children on the
premises does not exceed five (5) in number,
including in the count the children of the
resident family.
(b) That the age of the children, excluding those
of the resident family, shall not exceed
eleven (11) years of age.
(c) That prior approval of the building and use is
secured in writing from the Dade County Health
Department.
(d) That prior approval of the building and use is
secured in writing from the Dade County Fire
Department.
(e) That prior approval of the building and use
is secured in writing from the Florida Depart-
ment of Health and Rehabilitative Services.
(f) Where applicable, compliance with the
requirements of this Code, pertaining to
educational and child care facilities.
(g) Upon compliance with all conditions enumerated,
a Certificate of Use and Occupancy is secured
from the Dade County Building and Zoning
Department.
Section 2. If any section, subsection, sentence, clause
or provision of this ordinance is held invalid, the remainder o
ordinance shall not be affected by such invalidity.
Section 3. It is the intention of the Board of County

Section 4. This ordinance shall become effective ten
(10) days after the date of its enactment.
