A RESOLUTION ACCEPTING THE PLAT ENTITLED
WAGNER TRACT, A SUBDIVISION IN THE CITY OF MIAMI,
FLORIDA; AND ACCEPTING THE DEDICATIONS SHOWN ON
SAID PLAT; AND AUTHORIZING AND DIRECTING THE
CITY MANAGER AND THE CITY CLERK TO EXECUTE
THE PLAT.
WHEREAS, the City
Zoning Board and the Department of Public
Works have recommended the acceptance

The accompanying plat entitled WAGNER TRACT was prepared by.
J.H. Manucy, Inc. It is in correct form for submission to the City
Commission and is forwarded with a recommendation that it be
approved.
PERTINENT INFORMATION:
(1) The property platted is a subdivision of a portion of the
N.W. 1/4 of Section 35, Township 53 South, Range 41 East, +
and will consist of one tract having a total area of 1.462-

(7) In accordance with the requirements of Chapter 54, Section
d
54-20 of the Code of The City of Miami, Florida, Dade
County has entered into an Agreement with the City of Miami
for the construction of improvements: landscaping, asphaltic
concrete pavement, removal of sidewalk, sidewalk, curb and
gutter, storm drainage structures, sanitary sewers and
rip -rap bulkhead.
(8 ) The location of the property is shown colored in red on the
accompanying copy of a portion of City of Miami, Florida,
Atlas Sheet No. 24.
(9) The attached Resolution has been prepared for the acceptance
of the Plat by the City Commission of Miami, Florida.

AGREEMENT FOR CONSTRUCTION OF CERTAIN IMPROVEMENTS
AT WAGNER TRACT
WHEREAS, DADE COUNTY, a political subdivision of the State
of Florida, (hereinafter referred to as the 'Owner), concurrently
with the delivery of this Agreement, has applied to THE CITY OF
MIAMI, FLORIDA, (hereinafter referred to as the "City"), for
the acceptance and confirmation by the Commission of said City,
of a certain proposed plat of a subdivision to be known as
WAGNER TRACT located, at. N.W. 16 Street and Wagner Creek, a copy
of which proposed plat is attached hereto and made a part hereof
as Exhibit "A".
WHEREAS, the execution of this Agreement by the Owner does
not waive his immunity from taxes or special assessments; and
WHEREAS, this Agreement when executed will testify to the
Owner's intention to plat and install the required improvements
as set forth herein; and
WHEREAS, the completion of the improvements as set forth
herein will not be required prior to the acceptance of the plat
by the City Commission.
NOW, THEREFORE, the Owner hereby covenants and agrees with
the City as follows:
Within one (1) year from the effective date of the
acceptance and confirmation of said plat by the Commission of
the City, or prior to the issuance by the City of a Certificate
of Occupancy for the premises, the Owner will construct, or
cause to have constructed, at his own expense and in accordance
with standard specifications of the City, the following listed
improvements:

2. Detailed construction plans for theimprovements as
set forth in Section 1 hereto, have been developed by
Irbye G. Giddens, Consultant for the Owner.
Although one year is. allowed for the completion of the
aforementioned improvements, it is not in the public interest
that such construction work should be prolonged to the extent
that it would have a disorganizing effect upon the neighborhood.
After the work is started, the Owner hereby agrees to prosecute
said work progressively so as to complete it in a reasonable
length of time.
3. The Certificate of Occupancy for any . building or buildings
constructed on the property platted shall not be issued by the
City Building Department until the Owner has fully and faith-
fully performed the work in accordance with the terms of this
Agreement and has submitted to the City Department of Public
Works a letter from a Registered Land Surveyor certifying that
the Permanent Reference Monuments indicated on the plat have been
installed and properly placed.

This memorandum is sent pursuant to your request for an
opinion concerning title to the real property legally described as:
Commence at the center of Section 35, Township
11.1 (,) 53 South, Range 41 East, thence run North along
the East line of the NW 1/4 of said Section 35
: • for 819.05 feet, thence run West 410.00 feet to

An aPPlicatioh for final approval of the plat in accordance
with Chapter 28 of the Metropolitan Code is being prepared.
Section 28 -2(d)(3) of the Metropolitan Code provides that
the application for final approval must be accompanied by a
"Current opinion of title from an attorney
authorized to practice law in this state."
In compliance with this provision of the Code, I certify
that I am an attorney authorized to practice law in the State of
Florida.
Dade County acquired title to the above -described property
pursuant to a Deed to Dade County dated January 13, 1954, filed
January 15, 1954, under Clerk's File DD5958 (Deed Book 3868,
Page 444). Based on the review of the abstract by HUD, I am of
the opinion that, subject to any restrictions, limitations
liens of record, Dade County has good and marketable title
