HomeMy WebLinkAboutO-09005• RFC/rt. 10/4/79 ORDINANCE NO. 90 05 { AN ORDINANCE AMENDING THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY AMENDING CHAP- TER 27 THEREOF ENTITLED "LAND FILLS AND WATER- FRONT IMPROVEMENTS", BY AMENDING SECTION 27-3; SUBSECTIONS (a) AND (b) OF SECTION 27-17, AND SECTION 27-26 THEREOF, PROVIDING THEREBY FOR AN INCREASE IN FEES ESTABLISHED UNDER SAID SUB- SECTIONS AND FOR THE ELIMINATION OF THE PREVIOUS WAIVER OF FEES FOR FILLING OF UPLAND OR SUBMERGED PROPERTY AND FOR PUBLICATION FEES IN CONNECTION WITH PETITIONS FILED UNDER SAID CHAPTER, AS WELL AS THE FEE FOR THE REMOVAL OF FILL FROM SUBMERGED OR SURFACE LANDS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; DISPENSING WITH THE REQUIREMENT OF READING THE SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Chapter 27 of the Code of the City of Miami, Florida, as amended, entitled "Land Fills and Water- front Improvements" is hereby further amended in Section 27-3 1/ thereof in the following particulars: "Sec. 27-3. Same --Fees; expiration; renewal. The permit fee for filling upland property that is below the design grade shall be one hundred fifty dollars for the first ten thousand square feet of area to be filled, and twenty -€#tie fifty dollars for each additional five thousand square feet of area or frac- tion thereof. The permit fee for filling submerged land shall be one hundred fifty dollars for each acre or fraction thereof. Permits issued for filling shall be in effect for only one year from the date of issu- ance. Such fill permits may be renewed annually for a fee of €fifty one hundred dollars. The fee required under this section shall be waived for governmental entities and agencies." Section 2. Chapter 27 of the Code of the City of AM Miami, Florida, as amended, entitled "Land Fills and Water- front Improvements" is hereby further amended in Subsec- tions (a) and (b) of Section 27-17 thereof in the following 1/ particulars: 1/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures constitute the amend- ment proposed. Remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. "Sec. 27-17. Fees and charges. The following schedule of fees shall be charged in connection with this article: (a) For publication and notification of property owners payable at the time of filing a petition, a minimum of twenty fifty dollars. (b) For removal of sand, rock or earth by pump- ing or otherwise, from lands submerged, or otherwise, as estimated by the director of public works and pay- able upon issuance of a permit, one hundred fifty dollars, for the first one thousand cubic yards or fraction thereof, and twenty-five fifty dollars for each additional one thousand cubic yards or frac- tion thereof. *1t Section 3. Chapter 27 of the Code of the City of Miami, Florida, as amended, entitled "Land Fills and Waterfront Improvements" is hereby further amended in Section 27-26 1/ thereof in the following particulars: "Sec. 27-26. Same --Fees. The permit fee for any structural improvement covered by this article, excluding the cost of any electrical, mechanical and plumbing work requiring separate permits, shall be based upon the estimated construction costs and shall be a flat fee of one hundred fifty dollars plus one percent of the estimated construction cost. The expense of any inspection by the depart- ment of public works will be included in the cost of the permit fee. The fee required under this section shall be waived for governmental entities and agencies." Section 4. All ordinances or parts of ordinances in in conflict herewith, insofar as they are in conflict, are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. 1/ Words and/or figures stricken through shall be deleted. (For Commission Meeting of October 17, 1979) Ordinance This department recommends the adoption of the attached ordinance revising certain fees collected by the Department of Public Works, under Section 27 of the City Code. In accordance with discussion at our department budget reviews, attached please find a proposed ordinance amending the Section 27-3, 27-17 and 27-26 of the existing City Code. These revisions increase fees for permits issued by the Department of Public Works as follows: Section 27-3 Increases the fee for a permit to fill upland property from $100.00 to $150.00 for the first 10,000 square feet, and from $25.00 to $50.00 for each additional 5,000 square feet or less. The fee for renewal of permits to fill submerged and upland property is increased from $50.00 to $100.00 Section 27-17 Increases the fee for publication and notification of property owners regarding applications for Land Fills and Waterfront Improvements from $20.00 to $50.00 and for permits for removal of 1,000 cubic yards or less of sand, rock or earth from $100.00 to $150.00 and for each additional 1,000 cubic yards or less from $25.00 to $50.00 Section 27-26 Increases the flat fee for structural improvement permits in conjunction with Land Fills and Water- front Improvements from $100.00 to $150.00 These permit fees were last revised in 1972.
