HomeMy WebLinkAboutO-09004-/ -'1(F C / r r ]0/4/79 ORDINANCE NO. 9 0 0 4 4 AN ORDINANCE AMENDING THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY AMENDING CHAP- TER 2 THEREOF ENTITLED: "ADMINISTRATION", BY AMENDING SECTION 2-82.2 AND SECTION 2-85 OF SAID CHAPTER TO PROVIDE FOR AN INCREASE IN THE FEES FOR THE SERVICES OF THE DEPARTMENT OF PUBLIC WORKS IN PREPARATION AND PROCESSING OF COVENANTS RUNNING WITH THE LAND; BY PROVIDING FOR AN INCREASE IN THE FEES CHARGED FOR PROCESSING TENTATIVE PLATS AND RECORD PLATS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; DISPENSING WITH THE REQUIREMENTS OF READING THE SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 2-82.2 of the Code of the City of Miami, Florida, as amended, is hereby further amended in the 1/ following particulars: "Sec. 2-82.2. Same --Fee for preparation of covenants to run with the land. (a) For the preparation and processing of any legal document running with the land, covenanting the con- struction or postponement of construction of a public works improvement either in the public right-of-way or on private property, a fee of twenty -€eve fifty dollars shall be collected by the director of public works. The fee required under this subsection shall be waived for governmental entities and agencies. (b) In addition to the above tills Wen*y-€#ate fifty dollars fee, the covenantor shall also pay the recording fee, as established by the state. Section 2-85 of the Code of the City of Miami, Florida, as amended, is hereby further amended in the follow- 1/ ing particulars: "Sec.2-85. Check of record plats --Fee. The fees to be charged by the department of public works for processing tentative plats and record plats submitted for approval of the city, including the 1/ Underscored words and/or figures constitute the amendment proposed. Remaining provisions are now in effect and remain unchanged. inspection of the permanent reference monuments set in the field, are hereby fixed as follows: Fee Schedule (a) Record plat. (1) To accompany plat application $100.00 (2) For resubmission of tentative plat by same owner 50.00 (3) For resubmission of tentative plat by different owner 100.00 (4) To accompany final plat when submitted for recording 159T99 250.00 (b) Subdivision improvement time limitThe fee charged for each time limit extension granted for completion of subdivision improvements required in conjunction with a recorded plat 50.00 (c) Waiver of plat processing fees for governmental entities and agencies. The processing fees required by subsections (a) and 0) of this section shall be waived for governmental entities and agencies." Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 5. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. Cather Dire. or Depa� October 10, 1979 Ordinance Revising Fees Section 2 of City Code r.'-rlCL' orks (For Commission Meeting of October 17, 1979) This department recommends the adoption of the attached ordinance revising certain fees collected by the Department of Public Works under Sections 2-82.2 and 2-85 of the City Code. In accordance with discussions at our department budget reviews, attached please find a proposed ordinance amending Section 2 of the existing City Code. The proposed fee. revisions are: 2-82.2 Increases from $25 to $50 the fee for preparing a covenant to run with the land. 2-85 Increases the fee to accompany final plat when submitted for recording from $150 to $250, and the fee charged for time extension granted for comple- tion of subdivision improvements from $25 to $50.
