HomeMy WebLinkAboutO-09002• L RFC/rt 10/9/79 ORDINANCE NO. 9002 AN ORDINANCE REPEALING SECTION 39-6 OF THE CODE OF THE CITY OF MIAMI, AS AMENDED, IN ITS ENTIRETY, WHICH PERTAINS TO PROCEDURES AND USE CHARGES AT MUNICIPAL AUDITORIUM AND DINNER KEY RECREATION CENTER/EXHIBITION HALL AND SUBSTITUTING A NEW SECTION 39-6 BY REQUIRING PROSPECTIVE USERS TO PAY A CASH RESERVATION DEPOSIT EQUAL TO 10% OF THE BASIC USE FEE WITHIN 10 WORKING DAYS FROM THE DATE OF BEING SENT CONFIRMATION THAT A RESERVATION OF DATE(S) HAS BEEN MADE; ESTAB- LISHING A 50% ADVANCE PAYMENT REQUIREMENT WITH A FORFEITURE PROVISION; IDENTIFYING THE DINNER KEY RECREATION CENTER/EXHIBITION HALL AS "COCONUT GROVE EXHIBITION CENTER"; BY INCREASING SPECIFIED FEES FOR USE OF VARIOUS AREAS WITHIN THE AUDITORIUMS, AND FURTHER INCREASING CERTAIN SPECIFIED FEES DETERMINED BY THE TYPE OF EVENT BEING HELD; BY ESTABLISHING SETUP COSTS FOR LABOR AND MOVE -IN AND MOVE -OUT FEES; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the recent remodeling and complete refurb- ishing of the City auditorium known as Dinner Key Recreation Center/Exhibition Hall has resulted in the community's per- ception of the structure as a new entity entitled to a new name; and WHEREAS, "Coconut Grove Exhibition Center" as the name for the "new" structure has apparently won unanimous acceptance and recognition; and WHEREAS, a review of City auditorium rate structure and schedule reflects that an increase in rates is necessary to reduce the hugh operating deficit which has resulted from large fixed -operation costs and spiraling inflation; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 39-6 of the Code of. the City of Miami, Florida, as amended, is hereby repealed in its entirety and the following is hereby substituted in its place and stead: "Sec. 39-6. City Auditoriums --use rates and reservation require- ments, setup costs, move -in and move -out charges. (a) Unless otherwise indicated, all of the following provisions apply to both the Municipal Auditorium and to the Coconut Grove Exhibi- tion Center (formerly known as Dinner Key Recreation Center/Exhibition Hall). (1) Use rates include normal janitorial service, showtime airconditioning, normal house lights and such other items of avail- able equipment as may be necessary for the presentation of an event. (2) Use rates do not include event personnel or support ser- vices including: policemen, firemen, security guards, ushering staff, ticket sellers and ticket takers, stagehands, spotlight operators, musicians, projectionists, booth equipment, installing and dismantling electrical installation and setup of tables, chairs and portable stages. (3) Use rates are applicable to a day or fraction thereof. (4)(i) Persons or organizations wishing to use the said facili- ties shall be required to pay an amount equal to 10% of basic use fee as a cash reservation deposit within 10 working days from the date of notification being sent by the city, that a date(s) has been reserved; if this payment is not timely made, the reservation of date(s) shall be considered null and void. (ii) User must pay to city for use of said facilities the remaining 40% of a minimum 50% of the basic use fee no later than 30 days prior to moving into the premises. (iii) Unless otherwise governed by written agreement, payment of all monies for the use of said facilities are due at the time of use and must be made in cash or by cashier's check from a domestic bank. (5) The monies paid to the city under subsections (4)(i) and (ii) hereof will be forefeit if user cancels the event any time after the payment of monies under each such subsection. (6)(a) User shall have no right to transfer or assign any interest whatsoever in the city's agreement permitting use of said facilities unless such right shall have been provided for within said agreement of the city. -2- 90 0 2 •1 (b) MUNICIPAL AUDITORIUM USE RATE SCHEDULE: (1) Trade show, exhibitions, consumer shows: a. Caribbean Room $650 per day flat b. Gulfstream Room $550 per day flat (2) Public admission events: a. Caribbean Room $600 per day flat b. Gulfstream Room $500 per day flat (3) Noncommercial, nonprofit: a. Carribean Room $550 per day flat b. Gulfstream Room $450 per day flat (c) COCONUT GROVE EXHIBITION CENTER USE RATE SCHEDULE: (1) Trade shows, exhibitions, consumer shows: a. Main Hall and West Exhibit Area (i) Three day scheduled show or less 25i per square foot sold* Minimum guarantee per show. $3,000 (ii) Four day scheduled show through six days 30i per square foot sold* Minimum guarantee per show $4,000 (iii) Shows exceeding six days in scheduled length -- an additional charge of. $1,000 per scheduled day will be added to the above minimum charge per show. b. Mezzanine 10i per square foot sold* Minimum guarantee per day if no other Center area is used $350 c. Courtyard 54 per square foot sold* (i) Minimum guarantee per day $350 *This term reflects amount of space sold by user to exhibitors. -3- 90 0 2 (ii) Maximum payment per day if used in conjunction with Main Hall $125 d. Main Hall (i) Three day scheduled show or less 25,4 per square foot sold* Minimum gurantee per show $2,500 (ii) Four day scheduled show through six days 304 per square foot sold* Minimum guarantee per show $3,000 (iii) Shows exceeding six days in scheduled length -- an additional charge of $500 per scheduled day will be added to the above minimum charge per show. e. West Exhibit Area (i) Three day scheduled show or less 254 per squre foot sold* Minimum guarantee per show $1,000 (ii) Four day scheduled show through six days 30i per square foot sold* Minimum guarantee per show $1,2000 (iii) Shows exceeding six days in scheduled length -- an additional charge of $100 per scheduled day will be added to the above minimum charge per show. *This term reflects amount of space sold by user to exhibitors. -4- 9002 (2) PUBLIC ADMISSION EVENTS: a. Main Hall and West Exhibit Area...$2,000 or 10% of ticket sales, after taxes, whichever is greater. b. Main Hall $1,500 or 10% of ticket sales, after taxes, whichever is greater. c. West Exhibit Area $600 or 10% of ticket sales, after taxes, whichever is greater. d. Mezzanine $400 or 10% of ticket sales, after taxes, whichever is greater. e. Courtyard $500 or 10% of ticket sales, after taxes, whichever is greater. (3) NONCOMMERCIAL, NONPROFIT: a. Main Hall $1,200 per day flat. b. West Exhibit Area $600 per day flat. c. Mezzanine $350 per day flat. d. Courtyard $400 per day flat. (d) MOVE -IN OR MOVE -OUT: (1) For Shows, Exhibits and Conventions one to three days in duration: 2 days move -in and 2 days move -out at no additional charge (see NOTE). (2) For Shows, Exhibits and Conventions four or more days in duration: 4 days move -in and 3 days move -out at no additional charge (see NOTE). NOTE: Any additional time required is at the rate of one-half day rental fee per day. (e) SETUP COSTS FOR LABOR: (1) Chairs $10c each. (2) Tables 25c each. (3) Portable Stage $10 per section." Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this ordinance is declared invalid, -5- 9002 the remaining provisions of this ordinance shall not be affected. FL^RICA 17d717.P-G — FILE :AEi41OfANDUM October 9, 1979 RE"P':R _NCES• FILE Ordinance Establishing New Use Charges Municipal Auditorium and Coconut Grove Exhibition Center Second Reading - Meeting of October 17, 1979 (1) In reviewing the subject ordinance with the staff of the Department of Stadiums and Marinas, following the first reading on September 27, 1979, we have added language to reflect that the required 10% cash reservation deposit is to be credited toward payment of the facility use charge. The time for final pay- ment of all use charges has been established generally as the time of use with a requirement that such final payment be made in cash or a cashier's check. The term "use" has been substituted for the word "rental" or "lease" and a general prohibition against transferability has been added. The above changes, together with several changes in the amounts charged, are not substantial and a second reading is deemed proper.
