ORDINANCE NO. 90 01
AN EMERGENCY. ORDINANCE DEFINING AND DESIGNATING THE
TERRITORIAL LIMITS OF THE CITY OF t4IAMI FOR THE PURPOSE
OF TAXATION; FIXING THE MILLAGE AND LEVYING TAXES IN THE
CITY OF MIAMI, FLORIDA, FOR THE FISCAL YEAR BEGINNING
OCTOBER 1, 1979, AND ENDING SEPTEMBER 30, 1980; CON-
TAINING A SFVFRABILITY CLAUSE
WHEREAS, the City of Miami estimates that the nonexempt aggregate
valuation of taxable property, both real and personal in the City of Miami,
Florida, for the year beginning October 1, 1979, and ending September 30, 1980
is $4,439,979,680; and
WHEREAS, at an election held September 2, 1925, the City of Miami
did annex certain territory unincorporated at the time of such election, and
did annex certain other territory incorporated at the time of such election;
and
WHEREAS, from time to time other territory has been included in the
corporate limits of the City of Miami by legislative acts;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. For the purpose of this ordinance the "City of Miami" is
defined to be, includes, and designates the City of Miami as it now exists
with its extended territorial limits as set forth in the paragraphs prefatory
hereto.
Section 2. There shall be and hereby are levied upon the nonexempt
assessed value of all property, both real and personal, in the City of Miami
as described in Section 1 hereof, taxes at the rate shown below for the fiscal
year beginning October 1, 1979, and ending September 30, 1980, for the fol-
lowing purposes:
(a) A tax of 10.000 mills on the dollar for
the General Fund.
(b) A tax .of 3.96 mills on the dollar to
provide for the payment of maturing prin-
cipal and interest, and charges and re-
quirements related thereto, of indebted-
ness incurred subsequent to the adoption
of the Homestead Exemption Amendment to
the Constitution of the State of Florida,
and subject to the terms thereof.
These millages total 13.96.
Section 3. If any section, part of section, paragraph, clause,
phrase, or word of this ordinance shall be held to be unconstitutional or
void, the remaining provisions of this ordinance shall, nevertheless, remain
in full force and effect.
Section 4. This ordinance is hereby declared to be an emergency measure
on the grounds of urgent public need fog' the preservation of peace, health, safety
and property of the City of Miami, and upon the further ground of the necessity
to make the required and necessary payments to its employees and officers, payment
of its contracts, payment of interest and principal on its debts, necessary and
required purchases of goods and supplies, and to generally carry on the functions
and duties of its municipal affairs.
Section 5. The requirement oreading this ordinance orr two separate
days is hereby dispensed with by a vote of not less than four -fifths of the
members of the Commission.

Establishment of Municipal
Property Tax Rates for
Fiscal Year 1979-80
Pursuant to the City Charter, the City Commission is required to levy
such taxes as may be necessary to meet next year's appropriations,
less the estimated amount of revenue from other sources, including the
amount to be raised for the payment of the City's debt. To this end,
please find attached a proposed ordinance establishing millage rates
for; General Operating Purposes and Debt Service.
The proposed millage rate of 13.96 mills (10 mills for General Operat-
ing Purposes and 3.96 mills for Debt Service) is shown as follows and
represents.a decrease of 0.527 mills over the current year's rate.

It is recommended that the attached millage rate ordinance be placed
as an emergency measure on the September 27, 1979, Commission Agenda,
which will be the last City Commission meeting for the current fiscal
Year.
