HomeMy WebLinkAboutO-089921 4 ORDINANCE NO. 8 9 9 2 AN ORDINANCE AMENDING SECTION 38-16 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, RELATING TO THE FEE CHARGED FOR THE ISSUANCE OF IDENTIFICATION CARDS BY THE POLICE DEPARTMENT; PROVIDING FOR THE INCREASE OF SAID FEE FROM FIVE DOLLARS TO EIGHT DOLLARS; MAKING IT UNLAWFUL TO FURNISH FALSE INFORMATION; REPEALING ALL ORDINANCES IN CONFLICT HEREIN; AND CONTAINING A SEVERABILITY PROVISION. WHEREAS, the City of Miami Police Department pro- vides a special service to persons employed in businesses by registering, fingerprinting, photographing and issuing an identification card to said person(s); and WHEREAS, the number of persons applying for and receiving these identification cards has increased; and WHEREAS, the Police Department's operating costs have increased since the enactment of the present fee; and WHEREAS, the City of Miami Identification Card is accepted as positive proof of identification; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 38-16 of the Code of the City of Miami is hereby amended in the following particu- lars:l/ Section 38-16. Same --Identification Card -- Issuance; Contents; Fee. Every employee or person under contract for services, registered as provided in Section 38-15, shall have an identification card at all times during services under contract or employment. The fee for the issuance of such identification card shall be five eight dollars. It shall be unlawful for any person to knowingly furnish false information to the Police Department in the course of obtaining an identification card. 1/ Words and/or figures stricken through shall be deleated. Underscored words and/or figures constitute the amend- ment proposed. The remaining provisions are now in effect and remain unchanged. o. Section 2. All ordinances, code sections, or parts thereof in conflict herewith, insofar as they are in conflict, are hereby repealed. Section 3. If any section, sentence, clause, phrase, or word of this ordinance is for any reason held or declared to be unconstitutional, inoperative, or void, such holding or invalidity shall not affect the remaining portions of this ordinance, and it shall have been construed to have been the intent of the Commission of the City of Miami to pass this ordinance without such unconstitutional, invalid, or inopera- tive part therein, and the remainder of this ordinance after the exclusion of such part or parts shall be deemed and held to be valid as if such parts had not been included therein. Harms Chief of Police September 14, 1979 riLE• LEG 9-2 x IDT 2-1 x FIN 22 ' Ordinance for Fee Increase of Civilian Identification Cards ♦ The attached ordinance, which I am recommending, is submitted for your review and inclusion on the Commission Agenda for the September 27th, 1979, City Commission meeting. This ordinance will amend Section 38-16 of the City Code by increasing the fee of Civilian Identification Cards issued by the Police Depart- ment from five dollars ($5.00) to eight dollars ($8.00). This ordin- ance will also make it unlawful for persons to provide false informa- tion in obtaining civilian identification cards. The following is provided as background information to the proposed ordinance: The Police Department currently charges eight dollars ($8.00) for public record copies as required by City Ordinance and this proposed ordinance would set the Civilian Identification Card Fee at the same level as our public record copy fee. The last Civilian Identification Card Fee increase was authorized by City Ordinance in 1976 when the fee was increased from two dollars ($2.00) to five dollars ($5.00). The Miami Police Civilian Idnetification Detail processed 1,443 ap- plicants for identification cards during the period January 1, 1978, through June 30, 1978. During the same period for 1979, 2,731 ap- plicants were processed. This represents an 89% increase for the first six months over the previous year. If this increase remains proportional for the remainder of 1979, approximately 7,243 appli- cants will be processed during 1979. The following figures represent revenue potential for 1979-80 pro viding the fee increase to eight dollars ($8.00) is approved effective January 1, 1980.
