Having read the complaint for Revocation of Certificate of Public Convenience and Necessity No. C-421 belonging to Brownsville Jitneys No. 1 and No. 2, and operated' by Columbus Nelson, Jr., 2960 N..W. 208th Terrace, Miami, Florida, and having heard the evidence presented by a` representative of the Miami Police Department Taxicab Unit, 1 Certificate of Public Convenience No`. ENCLOSURES': (2) FILE: LIC 4 The Police Department respectfully requests that the City Commission revoke City Certificate of Public Convenience and Necessity #C-421 belonging to Brownsville Jitneys #1 and #2, formerly operated by Columbus Nelson, Jr. The Brownsville Jitneys #1 and #2 have failed or neglected, for a period of eleven (11) to eighteen (18) months, to render the full service authorized by the certificate. Chapter 56-18 of the City Code states that certificates shall be subject to revocation where it appears that the operator has failed or neglected for a period of eight (8) months during any calendar year to render the full service authorized by the certificate. The following is a list of vehicles permitted under City Certi- ficate #C-421, and the amount of time they were not in use: Brownsville Jitney #1 18 months Brownsville Jitney #2 11 months Mr. Columbus Nelson, Jr., was contacted by Sgt. V. T. Campbell, supervisor of the Taxicab Detail on several occasions, and advised he was going to start running the Brownsville Jitney route again. On March 5, 1979, Mr. Nelson was contacted by Sgt. Campbell and Mr. Nelson refused to speak to Sgt. Campbell in reference to his jitney service. He also failed to return our previous calls. On April 24, 1979, Mr. Columbus Nelson was advised by Registered mail that he was in violation of City Code 56-18, and to please contact Sgt. V. T. Campbell within the next seven (7) calendar days, otherwise steps would be taken to institute revocation "SUPPORTIVE DOCUMENTS FOLLOW" 79 7 37 Joseph R. Grassie City Manager Complaint for Revocation - Jitney Certificate I have been advised by the Chief of Police of a complaint against the holder of a Certificate of Public Convenience and Necessity. The Chief has caused the complaint to be investigated and has made a determination that the two vehicles authorized to operate under certificate #C-421 have beeninactive for an unacceptably long period of time. Pursuant to Section 56-19 of the Miami City Code, you are hereby instructed to give five (5) days notice by certified. mail to the operator of the certificates, Columbus Nelson, Jr., 2960 N. W. 208 Terrace, enclosing a copy of the complaint, and advising him that a hearing will be held before the Miami City Commission to determine whether the certificate #C-421 shall be revoked, suspended or altered. Mr. Columbus Nelson, Jr., has refused to make known his intentions with regard to resuming operation of his jitneys, failing to return phone calls of Sgt. Campbell, Miami Police Department Taxicab Unit, and E. I-Ie also failed to return our previous calls On 24 April 1979, Mr. Nelson was advised by registered mail that he was in violation of City Code 56-18, and to please contact Sergeant Campbell within the next seven calendar days, otherwise steps would be taken to institute revocation proceedings to cancel Certificate #C-421.
