HomeMy WebLinkAboutO-09013ORDINANCE NO. 90 1 3 AN ORDINANCE AMENDING SECTION 43-8 OF THE CODE OF THE CITY OF PI[AMI, FLORIDA, RELATIVE ID CERTAIN FEES CHARGED AND SERVICES FURNISHED BY THE POLICE DEPARTMENT; PROVIDING FOR THE INCREASE OF THE FEE CHARGED BY THE POLICE DEPARTMENT TO PERSONS FOR THE TAKING AND FURNISHING OF FINGERPRINTS TO SUCH PERSONS FROM FIVE DOLLARS TO EIGHT DOLLARS; PROVIDING FOR A FEE INCREASE OF EIGHT DOLLARS TO TWELVE DOLLARS WHEN THIS FINGER- PRINTING SERVICE IS PERFORMED OUTSIDE OF THE POLICE DEPARTMENT; PROVIDING FOR THE FURNISH- ING OF A PHOTOGRAPH FOR A FEE OF FIVE DOLLARS; PROVIDING FOR THE COLLECTION OF A SIGNATURE NOTARIZATION FEE OF FIFTY CENTS; MAKING IT UNLAWFUL TO FURNISH FALSE INFORMATION; CONTAINING A REPEALER PROVISION AND A SEVER - ABILITY CLAUSE. WHEREAS, the City of Miami Police Department provides a special service to any person by taking fingerprints and furnishing a card with the fingerprints thereon to such person; and WHEREAS, the number of persons requesting this special service has increased since the enactment of the present fee; and WHEREAS, services have WHEREAS, the Police Department's operating costs for these increased; and most persons requesting the fingerprinting service also request to purchase a photograph and/or signature notari- zation; and WHEREAS, the Police Department is not presently authorized to perform photograph and signature notarization services in conjunction with the fingerprinting service; and WHEREAS, the Police Department can furnish photograph and signature notarization services at the same time and location that persons are being fingerprinted; and WHEREAS, the revenues from these additional services would help defray increasing Police Department operating costs and it would be a public convenience to have the fingerprint, photo- graph, and notary services performed at the Police Department; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI: ctrir MAMMON MEETING OF OCT31 1979 ORDINANCE 1 3 Ut READING 2a4 READING Section 7.. Section 43-8 of the Code of the City of Miami, Florida, is hereby amended in the following particulars:1/ Sec. 43-8. Furnishing of information from police records; fees for certain services of police department. (a) (b) The department of police may, upon re- quest, take the fingerprints of any person and furnish such person a card with the fingerprints thereon for the sum of five eight dollars for each card furnished when the fingerprints are taken in the office of the department. When the fingerprints are taken elsewhere, the card may be furnished for the sum of eight twelve dollars for each card. (1) * * * * * * (c) (4) The department of police may, upon request, photograph any person for the purpose of identification. The sum of five dollars shall be collected for each photo- graph furnished said person. (c) (5) The sum of fifty cents shall be collected for each notary public certifi- cate which may be issued to a private person at the time the above services are furnished where the certificate is issued by an on -duty employee who has obtained a notary public commission at the expense of the City. (e) It shall be unlawful for any person to knowingly furnish false information to the police department in the course of obtaining the herein fingerprint cards or photographs. Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. 1/ Words and/or figures stricken through shall be deleted. This ordinance will amend Section 43-8 of the City Code by increasing the fee for taking and furnishing of fingerprints. In addition, the ordinance will authorize the Police Department to take and provide photographs of persons upon request for five dollars ($5.00) per photograph and to notarize signatures for fifty cents (500 per certificate, FINGERPRINTING INSIDE THE POLICE DEPARTMENT The last fee increase for this service was in 1976, when the charge was increased from one dollar to five dollars. The Miami Police Civilian Identification Detail processed 1,454 applicants for finger- print cards during the period of January 1, 1978, through June 30, 1978. During the same period for 1979, 2,748 applicants were pro- cessed. This represents an 89% increase for the first six months over the previous year. If this increase remains proportional for the remainder of 1979, approximately 5,398 applicants will be pro- cessed during 1979: The following figures represent potential revenue for 1979 at $5.00 and the projected earnings providing the fee increase of $8.00 is approved effective January 1, 1980. This figure for 1.980 does not reflect an increase in applicants since the effect of the rate in- crease on the number of applicants expected during 1980 cannot be determined at this time: 1978 - 2,856 applicants @$5.00 = $14,280 1979 - 5,398 applicants @$5.00 = $26,990 1980 5,398 applicants @$8.00 = $43,184 FINGERPRINTING OUTSIDE THE POLICE DEPARTMENT The revenue potential provided by the fee increase from eight dollars. ($8.00) to twelve dollars ($12.00) for fingerprinting outside the Police Department cannot be established as this service was not pro- vided during 1978 or as yet in.1979. Harms PHOTOGRAPHS September 14, 1979 Ordinance for Fee Increase The Civilian Identification Detail could provide regular photographs with a minimum of effort and cost. The fee of five dollars ($5.00) per photograph would cover materials and labor leaving a good profit margin. Most requests for photographs at the present time are for passport photos. Passport photos differ from regular photos due to the restric- tions of quality, size and the requirement of two identical poses to be made simultaneously. To provide passport photos, a special camera will have to be purchased. This camera would cost $458.15 plus $55.00 for a tripod. The recommended camera is a Polaroid Model 202-2 available at Pittman Photo Supply or Treck Photo Supply. The same type of polaroid film currently in use can be used. This service of passport photos could necessitate additional trained personnel. The revenue potential appears good because of the numerous requests for this service received daily by Civilian Identification.It ap- pears numerous persons requesting fingerprint cards also need pass- port and/or regular photos. NOTARIZATION SERVICE The providing of a notarization service for fifty cents (50) would be the same fee now charged by Dade County. Most requests for this service are for out-of-state or out -of -country papers (example: visas). The law requires that for a regular notary in the State of Florida to notarize any out-of-state papers, they must first record their notary certificates at the Dade County Courthouse, 73 West Flagler Street, Room 133. There is a recording fee of $4.00 for each notary. As most of our present requests are for out-of-state notarizations, this expenditure would seem appropriate. The revenue potential does not seem as great as that of the other services but would provide a service that often accompanies requests for a fingerprint card or photo. If the City of Miami decides to provide this service, additional personnel as notaries might be needed. The current cost to become a notary of the State of Florida is $37.50 without insurance and $42.50 with insurance. The`$4.00 recording fee to Dade County would be an additional cost and brings total amount to $46.50.
