HomeMy WebLinkAboutR-79-0769RESOLUTUION NO. 7 9- 7 69 A RESOLUTION DECLARING AND CERTIFYING THE RESULTS OF THE SPECIAL MUNICIPAL ELECTION HELD ON NOVEM- BER 6, 1979 FOR THE PURPOSE OF VOTING FOR THE APPROVAL OR DISAPPROVAL OF THE FOLLOWING: CHARTER AMENDMENT NO. 3 WHICH PROPOSED AN AMENDMENT TO SECTION 53 OF THE CITY CHARTER TO PROVIDE FOR AN INCREASE IN THE CONTRACT PRICE FROM $1,000 TO $4,500 FOR ANY PUBLIC WORK OR IMPROVEMENT CONTRACT BEFORE REQUIRING PUBLIC ADVERTISEMENT AND COM- PETITIVE BIDDING; FURTHER PROVIDING FOR THE REQUIRE- MENT OF PUBLIC ADVERTISEMENT AND OPEN -COMPETITIVE BIDDING BEFORE THE SALE, CONVEYANCE, OR DISPOSITION OF ANY REAL PROPERTY, INCLUDING LEASEHOLD INTEREST THEREIN, OWNED BY THE CITY OF MIAMI, THE DEPARTMENT OF OFF-STREET PARKING OF THE CITY OF MIAMI AND THE DOWNTOWN DEVELOPMENT AUTHORITY OF THE CITY OF MIAMI; SAID ELECTION RESULTING IN THE APPROVAL OF THE SAID PROPOSED CHARTER AMENDMENT. WHEREAS, a Special Municipal Election was duly held in the City of Miami, Florida, on November 6, 1979; and WHEREAS, said election was duly conducted in accord- ance with the provisions of the "Electronic Voting Systems Act" (F.S. 101.5601 through 101.5615); and WHEREAS, the official returns of,ea'ch of 87 election precincts in the herein election of November 6, 1979 have been duly certified by RALPH G. ONGIE, City Clerk, Supervisor of Elections for the City of Miami, Florida, •. v w ►1 i i1 rib ITEM NO and those official returns have been delivered to and duly canvassed by the City Commission;` NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The results of the Special Municipal elec- tion held in the City of Miami, .Florida, on November 6, 1979, are as follows: On the proposed Charter Amendment No. 3 which was duly submitted as follows: CITY COMMISSION MEETING OF NOV3 1974 owns itilz.L62 there were "Shall section 53 of the Charter of the City of Miami be amended to provide for an increase in the contract price from $1,000 to $4,500 for any public work or improvement contract before requiring public advertisement and competitive bidding; further pro- viding for the requirement of public advertisement before the sale, conveyance, or disposition of any real property, including leasehold interest therein, owned by the City of Miami, the Department of Off- Street Parking of the City of Miami and the Downtwon Development Authority of the City of Miami?" 11,537 votes cast for the approval of the said proposed amendment and 11,369 votes cast against the approval of the said proposed amendment, and the City Commission hereby finds, declares, and certifies that the said proposed amend- ment was approved by the electorate; further, the City Commission hereby declares the total number of ballots cast upon said proposed amendment, including absentee ballots, at said election in the 87 voting precincts was Section 2. The City Commission also hereby finds, declares and certifies: (a) said Special Municipal Election was duly and properly held and notice thereof was duly given in accord- ance with law: (b) all steps in connection with and leading up to said special election were duly, regularly and lawfully taken and had; and (c) all applicable provisions of the Consti- tution and statutes of the State of Florida, the Dade County Election Code, and the City Code have been duly complied with. Section 3. The City Clerkis hereby authorized and direc- ted to perform any and all incidental duties in connection herewith as required by law. PASSED AND ADOPTED th1-s8th day of NOVEMBER , 1979.
