Resolution ENCLOSURES: (For November 8, 197
Commission Meeting)
The Department of Public Works recommends the
adoption of a resolution accepting the com
pleted work and authorizing a final payment
of.$19.6,516.54 to M. R. Harrison Construction
Corporation for the BICENTENNIAL PARK -
PHASE II--1975 (COMBINED PROJECTS: 3 AND 4
UTILITIES, SITE DEVELOPMENT, LANDSCAPING, AND
IRRIGATION) (2ND BIDDING).
M. R. Harrison Construction Corporation has completed the
project consisting of completion of Bicentennial Park, includ-
ing the construction of a restaurant. The park is located
on Biscayne Bay between N. E. 9 Street and Interstate Highway
I-395. The original contract amount and the completed con-
struction cost is $3,473,000.00. It is recommended that no
liquidated damages be assessed, although changes in the
contractor's construction schedule toaccommodate park
dedication ceremonies caused an overrun of construction time.
Final payment on the project has been delayed because the
contractor initiated a law suit against the City for an amount
in excess of$300,000.00. The suit was the result of our
refusal to pay the contractor $165,000.00 in extras that he
requested. An agreement has been reached between the Law
Department and the attorneys for the contractor whereby we
will pay the contractor the remaining $20,821.64 of the cash
allowance as a full and complete settlement of his claim.
It is now in order for the Commission to accept the completed
work and authorize final payment, after all conditions are met.
