HARRISON CONSTRUCTION CORPORATION AT A TOTAL COST OF $3,473,000.00 FOR THE BICENTENNIAL PARK - PHASE II - 1975 (COMBINED PROJECTS 3 AND 4 - UTILITIES, SITE DEVELOPMENT, LANDSCAPING, AND IRRIGATION) " �� �! Harrison Construe tion Corporation; and WHEREAS, the work has been satisfactorily completed, and M. R. Harrison Construction Corporation has furnished the required documents certifying that all bills for labor and materials have been paid in full in connection with the aforesaid contract; and WHEREAS, a suit brought against the City has been settled by the Law Department; and WHEREAS, the City Manager and the Department of Public Works recommend that the completed work be accepted and final payment made to. the contractor;. NOW, THEREFORE, BE IT RESOLVED ByTHE COMMISSION �I%:r�' OF THE CITY OF MIAMI, FLORIDA: ITEM NO . rr Section 1. The completed work performed by M. R. Harrison Construction Corporation for the BICENTENNIAL PARK - PHASE II - 1975 (COMBINED PROJECTS 3 AND 4 UTILITIES, SITE DEVELOPMENT, LANDSCAPING, AND IRRIGATION) (2ND BIDDING) at a total cost of $3,473,000.00 is hereby approved. Section 2. The proper officials of the City of Miami are hereby authorized to pay $196,516.54 as full and final payment for all work performed and all materials furnished in connection with the BICENTENNIAL PARK - PHASE II - 1975 (COMBINED PROJECTS 3 AND 4 - UTILITIES, SITE DEVELOPMENT, LANDSCAPING, AND IRRIGATION) (2ND BIDDING).. Landscapin& Irrigation -(2nd "FLn`N EBidding) Final Payment Resolution ENCLOSURES: (For November 8, 197 Commission Meeting) The Department of Public Works recommends the adoption of a resolution accepting the com pleted work and authorizing a final payment of.$19.6,516.54 to M. R. Harrison Construction Corporation for the BICENTENNIAL PARK - PHASE II--1975 (COMBINED PROJECTS: 3 AND 4 UTILITIES, SITE DEVELOPMENT, LANDSCAPING, AND IRRIGATION) (2ND BIDDING). M. R. Harrison Construction Corporation has completed the project consisting of completion of Bicentennial Park, includ- ing the construction of a restaurant. The park is located on Biscayne Bay between N. E. 9 Street and Interstate Highway I-395. The original contract amount and the completed con- struction cost is $3,473,000.00. It is recommended that no liquidated damages be assessed, although changes in the contractor's construction schedule toaccommodate park dedication ceremonies caused an overrun of construction time. Final payment on the project has been delayed because the contractor initiated a law suit against the City for an amount in excess of$300,000.00. The suit was the result of our refusal to pay the contractor $165,000.00 in extras that he requested. An agreement has been reached between the Law Department and the attorneys for the contractor whereby we will pay the contractor the remaining $20,821.64 of the cash allowance as a full and complete settlement of his claim. It is now in order for the Commission to accept the completed work and authorize final payment, after all conditions are met.
