HomeMy WebLinkAboutO-09016ORDINANCE NO. 9 0 1 6 AN ORDINANCE AMENDING SECTION 2-103 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "ACCEPTING GIFTS, ETC., FROM PERSONS CONTRACTING, ETC., WITH CITY" BY ADDING A SUBSECTION THERETO CONTAINING PROVISIONS WHICH PROHIBIT ANY CANDIDATE FOR NOMINATION OR ELECTION TO THE CITY COMMISSION FROM SOLICITING OR ACCEPTING ANYTHING OF VALUE TO THE RECIPIENT THAT WOULD CAUSE A REASONABLY PRUDENT PERSON TO BE INFLUENCED IN THE DISCHARGE OF OFFICIAL DUTIES OR THAT IS BASED UPON ANY UNDERSTANDING THAT THE VOTE, OFFICIAL ACTION, OR JUDGMENT OF THE CANDIDATE WOULD BE INFLUENCED BY SUCH THING OF VALUE; CONTAINING A SEVERABILITY CLAUSE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 2-103 of the Code of the City of Miami, Florida, as amended, entitled: "Accepting gifts, etc., from persons contracting, etc., with city." is hereby amended 1/ in the following particulars: "Sec. 2-103. Accepting gifts, etc., from persons con- tracting, etc., with city. (a) Every officer, official or employee of the city, including every member of any board, commission or agency of the city, is expressly prohibited from accepting, directly or indirectly, from any person, company, firm or corporation to which any purchase order or contract is or might be awarded, any rebate, gift, money or any- thing of value whatsoever, except where given for the use and benefit of the city. (b) No candidate for nomination or election to the - city commission shall solicit or accept anything of value to the recipient, including a gift, loan, reward, promise of future employment, favor or service: (i) That would cause a reasonably prudent person to be in luenced in the discharge of official duties. (ii) That is based upon any understanding that the vote, official action, or judgment of the can- didate would be influenced the.reby.."_ 1/ Underscored words and/or figures constitute the amend- ment proposed. Remaining provisions are now in effect and remain unchanged. Section 2. If any section,.part.of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected.
