A RESOLUTION CERTIFYING AND DECLARING
THE RESULTS OF THE REGULAR ELECTION
HELD ON NOVEMBER 13, 1979 FOR THE
ELECTION OF A CANDIDATE FOR THE OFFICE
OF COMMISSIONER, GROUP II, OF THE CITY
OF MIAMI, FLORIDA.
WHEREAS, a Regular Election was duly held on Novem-
ber 13, 1979 for election of a candidate to the office of
Commissioner, GROUP II, of the City of Miami, Florida; and
WHEREAS, said Regular Election duly followed the Pri-
mary Election of November 6, 1979, both of which having been
conducted in accordance with law, including the provisions
of the "Electronic Voting Systems Act" (F.S. 101.5601 through
101.5616); and
WHEREAS, the official returns of each of 87 election
precincts in the herein election of November 13, 1979 have
been certified by RALPH G. ONGIE, City Clerk, Supervisor of
Elections for the City of Miami, Florida, and those official
returns have been delivered to and canvassed by the City
Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
• CITY OF MIAMI, FLORIDA:
Section 1. The Commission finds -and hereby declares
and certifies that the following candidates received the
number of votes set opposite their respective names:

Section 2. The total number of ballots cast at said
election in the 87 voting precincts was.

Section 3. It is hereby certified and declared that
in GROUP II (For Commissioner)
received a majority of votes cast in GROUP. II, and he shall
be considered elected and hold said office for a term of
four (4) years from Noon on November 15, 1979.
Section 4. The election was fairly held
Section 4. The City Commission also hereby finds,
declares and certifies: (a) said Regular Election was duly
and properly held and notice thereof was duly given in
accordance with law; (b) all steps in connection with and
leading up to said Regular Election were duly, regularly
and lawfully taken and had; and (c) all applicable provisions
of the Constitution and statutes of the State of Florida, the`.
Dade County Election Code, and the City Code have been duly
complied with.
Section 5. The City Clerk is hereby authorized and
directed to perform any and all incidental duties in connec-
tion herewith as required by law.

PRE -ELECTION LOGIC & ACCURACY TESTS
I, RALPH G. ONGIE, City Clerk of the City of Miami, Florida, do
hereby certify that all necessary legal steps in connection with the
conducting of a City of Miami Regular Election held on November 13,
1979 were followed, i.e., logic and accuracy tests were held on Friday,
November:9 ,::1979, using dummy ballots to determine that. the:computer
was functioning correctly, and a similar test was conducted beginning
at 5:00 o'clock P.M. on election night, Tuesday
November 13, 1979 and
that all documents concerning these logic and accuracy tests showed the.
computer to be functioning correctly and are in the possession of the
Supervisor of Elections of Metropolitan Dade County, under sealed vault.
I further certify that the results of the Regular Election held for
a Commissioner's seat in Group 2 are as follows:

The provisions of the City Charter require that the City
Commission elect the City Manager, City Clerk and City
Attorney. The term of the City Manager is indefinite and,
therefore, no resolution is required at this time to fill
this office (Section 15, City Charter).
I have prepared for your consideration the required resolu-
tions electing and reappointing Ralph G. Ongie, as City
Clerk, and myself, as City Attorney, to hold office until
the first meeting following the next regular City election
(Sections 4 and 21, City Charter).
You have approved a 7% increase in my salary, effective
October 1, 1979, by your adoption of the budget for Fiscal'
Year 1979-80 wherein the requisite funds were appropriated
