Home My WebLink AboutR-79-0817RESOLUTION NO. 7'9 8 17 A RESOLUTION EXPRESSING THE CONCERN OF THE MEMBERS OF THE CITY OF MIAMI CITY COMMISSION FOR THE WELFARE AND PROTECTION OF ITS LOW-INCOME AND MINORITY CITIZENS IN THEIR CONTRACTUAL RELATIONSHIPS WITH FLORIDA POWER AND LIGHT COMPANY; AND REQUESTING THE PUBLIC SERVICE COMMISSION TO REQUIRE THE FLORIDA POWER AND LIGHT COMPANY TO JUSTIFY THE IMPOSITION OF SECURITY DEPOSITS AND EXTRA CHARGES FOR THE RESTORATION OF INTERRUPTED SERVICES, AND FURTHER DIRECTING THE CITY CLERK TO FORWARD A COPY OF THIS RESOLUTION TO EACH MEMBER OF THE PUBLIC SERVICE COMMISSION. WHEREAS, approximately eighty percent (80)% of the popula- tion of the City of Miami consists of Black and Hispanic individuals, many of whom earn low incomes; and WHEREAS, the Public Service commission is studying the rate structure of Florida Power and Light Company; and WHEREAS, the Public Service Commission is examining the necessity for security deposits from the customers of Florida Power and Light Company in advance of, and as a condition precedent to, the connection or restoration of service and WHEREAS, the providing of electrical power is an essential service rendered by Florida Power and Light Company to the citizens of the City of Miami; and WHEREAS, the operation of the Florida Power and Light Company in the City of Miami is based upon a Franchise Agreement with the City of Miami and, therefore, deals with the public interest and welfare of the citizens of the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA "DOCUMENTENT i DEX IT[-j� NO. �� Section 1. In order to promote the welfare and protection of low-income and minority citizens of the City of Miami in their contractual relationships with Florida Power and Light Company, the CITY COMMISSION MEETING OF NOV 2 6 1979 REsoumor, ,o7 9 8 1 Public Service Commission is hereby requested to demand that the Florida Power and Light Company show the following: (a) A demonstrated need for a security deposit by prospec- tive customers of said utility company; (b) A demonstrated need for basing the amount of said deposit on the financial circumstances of individual prospective customers; (c) Justification for the imposition of additional deposits for the restoration of service where there is an interruption due to nonpayment; (d) Assurances that Florida Power and Light Company's administrative practices, policies and procedures do not result in discrimination against the low-income and minority citizens of the City of Miami. Section 2. The City Clerk is hereby directed to forward a copy of this resolution to each member of the Public Service Commission. PASSED AND ADOPTED this 26th day of November, 1979. Maurice A.
