HomeMy WebLinkAboutR-79-0814TVP/S/O 8/20/79 RESOLUTION NO. 7 9- 8 1 4 A RESOLUTION GRANTING A ONE YEAR EXTENSION OF THE CONDITIONAL USE, AS LISTED IN ORDINANCE NO. 6871, ARTICLE VI, SECTION 2(4-A) (a):, TO PERMIT A RESIDENTIAL DEVELOPMENT OF A PLANNED UNIT NATURE (PUN) ON LOT 29 .LESS 'V'LY PCIMION FOR E-'.rJ EXPRESSWAY RIGHT OF WAY; BLOCK 3; WALDIN ACRES (5-68), BEING APPROXIMATELY 3079 N.W. 11TH STREET, AS PER PLAN ON FILE, CONSISTING OF TWELVE (12) NEW DWELLING UNITS IN SIX (6) STRUCTURES WITH TWO (2) DWELLING UNITS PER STRUCTURE; ZONED R-2 (TWO-FAMILY). WHEREAS, Article XXXII of the Comprehensive Zoning Ordinance No. 6871, permits an extension of a Conditional Use by the City Manager with approval by the City Commission for a period of one year; and WHEREAS, the City Manager recommends a one year extension of the Conditional Use granted by the Zoning Board by Resolution No. ZB 68-79; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The request for a one year extension of the Conditional Use as listed in Ordinance No. 6871, Article VI, Section 2(4-A) (a), to permit a Residential Development of a Planned Unit Nature (PUN) on Lot 29 less N'ly portion of E-W Expressway right of way; Block 3; WALDIN ACRES (5-68), being approximately 3079 N.W. llth Street,as perplan on file, consisting of twelve (12) new dwelling units in six (6) structures with two (2) dwelling units per structure; zoned R-2 (Two -Family); be and the same is hereby granted. Section 2. This extension of the conditional use shall expire within six (6) months if not used. PASSED AND ADOPTED this 26 day of November , 1979. RALPH G. Blk. 3, Lot 29 less N'ly portion for E-W Expressway R-O-W REFERENCES: APProx. 3079 N.W. llth Street ENCLOSURES: ARTICLE XXXII of the Comprehensive Zoning Ordinance No. 6871 provides that any Conditional Use shall expire six months after the effective date of the Conditional Use unless a Building Permit or a Certificate of Use has been issued based upon the Conditional Use. The Ordinance further provides that the City Manager may, after review and -determination that substantial progress has been achieved by the applicant in terms of project planning, extend the expiration date of the Conditional Use for an additional period of time not to exceed one year, subject to approval of the City. Commission. This Department finds no objection to the granting of the ex- tension of time for this Conditional Use.
