HomeMy WebLinkAboutR-79-0809RESOLUTION NO. 7 9 3 0 9 A RESOLUTION GRANTING A CONDITIONAL USE AS LISTED IN ORDINANCE NO. 6871, ARTICLE V, SECTION 1(6) (b), TO PERMIT THE CONSTRUCTION OF A 20-SPACE OPEN PARKING LOT FOR PRIVATE PASSENGER VEHICLES ON LOT 1, BLOCK 3; SHENANDOAH MANOR SECTION "B" (39-81) BEING 1800 S.W. 21ST TERRACE, AS PER PLANS ON FILE, AS AN ACCESSORY USE TO THE BUILDING LOCATED ON LOTS 17 & 18, BLOCK 3; SHENANDOAH MANOR SECTION "B" (39-81) IN CONJUNCTION WITH VA.PIANCE APPLICATION: ZONED R-1 (ONE FAMILY). SUBJECT TO A 20' SET BACK FROM 21ST TERRACE A 15' SET BACK FROM 18TH AVENUE LANDSCAPING AS PRESENTED AND CONSTRUCTION OF A 5' WALL PROVIDED FOR INCLUSION OF A UNITY OF TITLE AGREEMENT. WHEREAS, the City of Miami Zoning Board, at its meeting of July 16, 1979, Item No. 7(a), following an advertised hearing, adopted Resolution No. ?B 161-79 by a 5 to 2 vote deriving the conditional use as hereinafter set forth; and WHEREAS, the applicant has taken an anneal to the City Commission, and WHEREAS, notwithstanding the denial of the Zoning Board, the City Commission, after careful consideration and due deliberation of this matter has determined that the conditional use requested meets all the Citv's requirements for said use NOW, THEREFORE, BE IT RESOLVEDBY THE COMMIS,StT'Oj�T OF THE CITY OF MIAMI, FLORIDA:[rtj LLA i M IT Section 1. EXPLANATION` Applicant states that this existing medical labora- tory has become a large operation and as such needs more space. The proposed addition to the existing building would allow the required expansion and eliminate the disruption that would be created by moving the equipment to a new location. RECOMMENDATIONS (a) APPROVAL IN ACCORD WITH THE PLANS ON FILE. SUBJECT TO PLANNING THE ADDITION OF A SOLID HEDGE ALONG THE EXTERIOR OF THE DEPARTMENT SIX-FOOT WALL. The proposed parking lot will not have any openings onto SW 21 Terracenor onto the residential portion of S" 18 Avenue. A solid wall will screen the parking from the residential neighborhood and if a solid hedge is provided along its exterior, it will not have a detrimental effect on the neighborhood. (b) APPROVAL OF THE FRONT YARD, SIDE STREET YARD AND PARKING VARIANCES IN ACCORD WITH THE PLANS ON FILE AND SUBJECT TO APPROVAL OF THE CONDITIONAL USE PARKING ON LOT 1. DENIAL OF THE ZERO FOOT SIDE YARD AND LOT COVERAGE VARIANCE REQUESTS. The front yard and street side yard variances already exist. These can be altered only through major alterations to the existing structure. The requested parking variance is acceptable since, if the conditional use parking is granted, the required amount of parking will be provided on the total site. The requested side setback and lot coverage variances are notacceptable however, since they have been self imposed. Side setbacks and lot coverage maximums were established in order to prevent the creation of solid walls and to encourage open spaces which are more compatible with the adjacent residential uses. The plans should be modified to provide the required setbacks and to reduce the lot coverage.
