HomeMy WebLinkAboutO-09020EHK/s1m 10/24/79 AMENDMENT NO. 1 TO ORDINANCE NO. 9000 ORDINANCE NO. 9 0 2 0 AN ORDINANCE AMENDING SECTIONS 1 AND 5 OF ORDINANCE NO. 9000, ADOPTED OCTOBER 17, 1979, THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1980, BY DECREASING THE APPROPRIATION FOR THE POLICE DEPARTMENT IN THE AMOUNT OF $173,822; DECREASING ANTICIPATED GENERAL FUND REVENUES FROM THE CAPITAL IMPROVEMENT FUND (FLORIDA POWER & LIGHT FRANCHISE FEES) IN THE SAME AMOUNT, THUS ELIMINATING THE SHORTFALL IN THAT FUND; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND DISPENSING WITH THE REQUIREMENT OF READING SAME ON TWO SEPARATE DAYS BY VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION. WHEREAS, the City Commission adopted Ordinance No. 9000 on October 17, 1979, establishing revenues and appropriations for the City of Miami, Florida, for the fiscal year ending September 30, 1980; and WHEREAS, said ordinance included a supplemental amount of $660,000 to fund 33 police officer positions in the Police Department; and WHEREAS, said supplemental amount resulted in a shortfall of $173,822 in the Capital Improvement Fund from which the supplemental appropriation was originally derived; and WHEREAS, it has now been determined that the requirement to fund the 33 additional Police Officer positions will be $486,178; and WHEREAS, the remaining appropriation of $173,822 can now revert to the Capital Improvement Fund, thus eliminating the shortfall in that Fund; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Sections 1 and 5 of Ordinance No. 9000 adopted October 17, 1979, the Annual Appropriations Ordinance for the Fiscal Year ending September 30, 1980, are hereby amended in the following particulars "Section 1. The herein reduction of $173,822 in the appropriation for the Police Department is a modification of the requirement for funding 33 additional police officer positions, and will allow for a decrease in anticipated General Fund revenues which were to have been received from the Capital Improvement Fund (Florida Power and Light franchise fees), thus eliminating the shortfall in the Capital Improvement Fund. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 5. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. Gary, Director Department of Management' and Budget October 25, 1979 Amendment No. 1 to Ordinance No. 9000: Decrease in the Police Department Appropriation Ordinance No. 9000, the Annual Appropriations Ordinance for fiscal year 1979-80, increased the original Police Department requested appropriation by $660,000 in order to fund 33 additional police officer positions. This amount was derived from the Capital Improvement Fund (FP&L franchise fee), which has an estimated shortfall of $173,822. As the Police Department will not be in a position to commence training of new recruits until at least mid -January 1980, the $660,000 is far greater than required. It is proposed, therefore, that the Police Department appropriation be reduced by $173,822. This amount will revert to the Capital Improvement Fund, thus eliminating the shortfall in that fund. The remaining $486,178 for the additional 33 police officer positions is considered sufficient for the remainder of the fiscal year.
