HomeMy WebLinkAboutO-09032tra ORDINANCE NO. 9 0 3 2 AN ORDINANCE AMENDING SUBSECTION (b) OF SECTION 39-2 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY REVISING THE FEE SCHEDULES FOR THE USE OF THE SHOWMOBILES BY QUASI -PUBLIC ORGANIZATIONS IN THE CITY OF MIAMI; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, rising costs to the DEPARTMENT OF LEISURE SERVICES have necessitated changing the structure for fees for the use of park facilities and services, including the showmobiles; and WHEREAS, it is essential that the fees be revised as pro- vided herein to allow charitable and nonprofitable organizations, beneficial to the community, a reasonable rate for rental of said showmobiles; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Subsection (b) of Section 39-2 of the Code of the City of Miami, Florida, as amended, is hereby further amended by 1/ revising the fee schedules in the following particulars: "Sec. 39-2. Use of community buildings, bandshell, etc., by quasi -public organizations. (b) The amounts to be paid for the use of the Bayfront Bandshell, the Torch of Friendship and Showmobiles shall be as follows: Showmobiles: (i) No charge for city sponsored activities. (aa) Hourly Rate - Small Showmobile (Game Time) at $5 per hour and Large Showmobile (Wenger at $10 per hour. (Included in these hourly rates is the basic setup of from 1-24 chairs, 1 podium and 1 microphone with built in sound system.) (bb) Full Setup - To be rented in conjunction with the Showmobile units only, at a rate of $25 per day, includes from 25-100 chairs, 1 podium, 4 micro- phones, 2 column speakers, amplifier and genera- tor. (Full setup requires a minimum of 2 men.) (cc) Direct Costs (Labor Small Showmobile Large Showmobile 24' x 8' - 1 man 24' x 16' - 2 men 24' x 25' - 3 men 32' x 8' - 1 man 31' x 16' - 2 men 32' x 24' - 4 men Direct costs will be determined as follows: Monday through Friday (8:00 AM - 6:00 PM) - No charge. Evenings, weekends & holidays - Time and one-half of the assigned employee's straight time hourly rate of pay. (iii) Rental fee rates for profit making organizations and organizations where the project, event or activity does not qualify under the criteria established in subsec- tion (b)(ii) hereof. (aa) Hourly Rate - same as (b)(ii)(aa) hereof, plus 15%. (bb) Full Setup - same as (b)(ii)(bb) hereof, except at the rate of $50 per day. (cc) Direct Costs - same as (b)(ii)(cc) hereof. (iv) All charges are exclusive of the appropriate tax and do not include, if required by the Department of Leisure Services, the cost of such additional recreational personnel as may be designated by the director of said department. *II Section 2. All ordinances, code sections or parts of ordinances, insofar as they are inconsistent or in conflict with the provisions of this ordinance, are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. The provisions of this ordinance shall become effective on January 12 1980. The current fee schedule for the City of Miami showmobiles have restricted charitable and non-profit organizations from their use in that it is beyond their financial capabilities. This has deterred many worthwhile events beneficial to the community. In an effort to assist in allowing the citizenry of Miami beneficial programs, and further recognizing that the potential increased volume would more than compensate the moderate reduction of said rates, it is recommended that the following fees be ratified: Charitable and non-profit organizations Profit making organizations which events benefit the community and/or not beneficial to community (a) Large showmobile $10.00 per hour Small showmobile $ 5.00 per hour (b) Rental with full set up, including $25.00 15-100 chairs, 1 podium, 4 microphones, 2 volume speakers, amplifier and generator (c) Direct cost - labor Monday through Friday, 8-6 P.M.
