HomeMy WebLinkAboutR-79-0897RESOLUTION NO. 79 8.97 A RESOLUTION GRANTING A ONE YEAR EXTENSION OF A CONDITIONAL USE AS LISTED IN ORDINANCE NO. 6871, ARTICLE VI, SECTION 1(4-A) (a), TO PERMIT CON- STRUCTION OF A RESIDENTIAL DEVELOPMENT OF A PLANNED UNIT NATURE (PUN) ON LOT 47 AND N 25' OF LOT 52, PALMHURST (7-22), BEING 3046 INDIANA STREET, AS PER PLANS ON FILE, CONSISTING OF THREE (3) DWELL'ING UNITS IN TWO (2) STRUCTURES, ZONED R-2 (TWO FAMILY) DISTRICT WHEREAS, Article XXXIIof the Comprehensive Zoning. Ordinance No, 6 871 permits an extension of a conditional use -by the City Manager, with approval of the City Comni.ssion, for a one year period; and WHEREAS, the City Manager recommends the extension of the Conditional use granted by Zoning Board Resolution No. Z B 14.4 - 7 9 ; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The request for a one year extension of the conditional use granted from Ordinance No., 6871, Article VI, Section 1(4-A) (a), to permit construction of a residential development of a PLANNED UNIT NATURE (PUN). on Lot 47 and N 25' of Lot 52,-PALMHURST (7-22), being 3046 Indiana Street as per plans on file, consisting of three (3) dwelling units in two (2) structures, zonedR-2 (Two -Family) District, be and the same is hereby granted. A Conditional Use to permit construction of a re- sidential development of a Planned Unit Nature (PUN) on above site, as per plans on file, consisting of three (3) dwelling units in two (2) structures. PUN's afford a more economical use of the land and allow flexibility in design. APPROVAL IN ACCORD WITH THE PLANS ON FILE. The proposed development meets the intent of the PUN regulations. There:is adequate space on site for the provision of private yards and automobile parking and use has been made ofsuch verticle spaces as roof decks and trellised balconies. Deferred on June 18, 1979 to have the owner present at the hearing. Approved on July 2, 1979 in accord with the plans on file. Pere-LugitheS Acting Director Planning & Zoning Boards Administration DATE: November 13, 1979 FILE: PALMHURST (7-22) Lot 47 & N25' of Lot 52; 3046 Indiana Street SUBJECT: fiErtftENCE.S: ENCLOSURES: ARTICLE XXXII of the Comprehensive Zoning Ordinance 6871 provides that any Conditional Use shall expire six months after the effective date of the Conditional Use unless a Building Permit or a Certificate of Use has been issued based upon the Conditional Use. The Ordinance further provides that the City Manager may, after review and deter- mination that substantial progress has been achieved by the applicant in terms of project planning, extend the expiration date of the Conditional Use for an additional period of time not to exceed one year, subject to approval of the City Commission. This Department finds no objection to the granting of the extension of time for this Conditional Use We are requesting the City Attorney's office, by copy of this memo, to prepare the proper Resolution for this extension. cc: Law Department Planning Department Tentative City Commission date: December 27, 1979.
