HomeMy WebLinkAboutR-79-0869RESOLUTION NO. 79-869 A RESOLUTION FIiNDING AND DETERMINING THE PUBLIC NEED AND NECESSITY FOR ACQUIRING THE FEE SIMPLE TITLE TO CERTAIN PROPERTY DESCRIBED HEREIN TO BE USED FOR A PUBLIC PARK: AND AUTHORIZIiIG THE CITY LAW DEPARTMENT TO INSTITUTE AND PROSECUTE TO A CONCLUSION ALL OF THE NECESSARY LEGAL ACTIONS TO ACQUIRE THE FEE SIMPLE TITLE TO THIS PROPERTY AS SOON AS IT IS LEGALLY POSSIBLE, INCLUDING THE FILING OF A DECLARATION OF TAKING. WHEREAS, the City of Miami is empowered by its Charter to acquire in fee simple by condemnation or otherwise property real or personal, or any estate or interest therein, for any of the purposes of the City; and WHEREAS, the City Commission finds that the acquisition of the fee simple title is and to property described in Section 1 is necessary for a public park; and WHEREAS, the City Commission finds that as soon as the subject property is acquired the City will be ready to begin development of the public park; and WHEREAS, it is necessary that appropriate steps to acquire the property described in Section l be taken so that said property may be made ready to accommo- date the public need for additional park facilities; and WHEREAS, Ordinance No. 9019, making appropriations for capital improve- ments for the fiscal year ending September 30, 1980, appropriated $762,300 in Section X. C. (i) 1. for an activity entitled "Blue Lagoon; and WHEREAS, the purpose of said appropriation was to provide funds to acquire the parcels of land described in Section 1, above and for landscape design services and administrative expenses; FLORIDA: NOW, THEREFORE, BE IT RESOLVED BY THE COh1MISAOP TH C. PARCEL 2 - 5145 N.W. 7th Street West 100 feet of East 2,304 feet of Tract 2, Miami Tract 2, Plat Book 28 at Page 10, Dade County, Florida, containing .93 Acres. PARCEL 3 - 5151 N.W. 7th Street Tract 3, Semrocsa Fourth Rev. and Amended, Plat Book 50 at Page 77, Dade County, Florida, containing 1.77 Acres. Section 2. That the City of Miami, Florida, its agents and employees are hereby authorized to acquire by gift, purchase or condemnation, the fee simple title in and to the property described in Section 1 above as soon as it is legally possible, including the filing of a declaration of taking and utilization of any and all statutes of the State of Florida applicable thereto. Section 3. The City of Miami, its employees and agents are authorized to incur all the necessary expenses to institute and maintain condemnation proceed- ings if the City Manager should determine that said condemnation proceedings are necessary and advisable in order to acquire the fee simple title any or all of the parcels of property described in Section 1 above. Grassie City Manager Carl Kern, Director Department of Parks December 7, 1979 Blue Lagoon It is recommended that the City take the appropriate steps to acquire the three parcels of land which compose the proposed Blue Lagoon Park per the attached resolution. The increase in the City's population in the western portion of the City has necessitated the acquisition of additional parkland to properly serve citizen needs. The Planning Department has identified three parcels of land on the north side of NW 7th Street between 5lst and 52nd Avenues as an appropriate park site. These parcels face Blue Lagoon and provide access to the fresh water canal system. The eastern parcel is a used car sales lot and is fully asphalted and contains two structures. The central parcel contains a magnificent stand of royal palms and is an Environmental Preserva- tion District. The western parcel contains a clubhouse and a boat ramp. THE CITY t1ANAGE,�Y, L;J i L :'I'`'" TO ACCEPT A GRANT AWARD FROM THE FLORIDA DEPARTMENT OF NATURAL RESOURCES FOR -A CAPITAL PROJECT ENTITLED "BLUE LAGOON PARK.__.•; .ACQUISITIONI AND FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY CONTRACT (S) AND/OR AGREEMENT (S) TO IMPLE- MENT TIIE PROJECT WITH FUNDS FROM THE TRUST AND AGENCY FUND "BLUE LAGOON PARK ACQUISITION". WHEREAS, the Florida Department of Natural Resources has recommended that the City of Miami be awarded'a grant of $333,410 to assist in the purchase of approximately 3.4 acres of land for a park along the southern shoreline of Tamiami Canal; and WHEREAS, this project will provide. Miami residents with boat access to Blue Lagoon; and WHEREAS, sufficient funds have been identified within the 1972 Parks for People Bond Fund to provide the required cash match; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE co?4nlSSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby authorized to accept a grant award from the Florida Department of Natural Resources for,a capital project entitled "Blue Lagoon Park Acquisition". Section 2. The City Manager is hereby authorized toexecute the necessary contract (s) and/or agreement (s) to implement the project with funds from the Trust and Agency Fund "Blue Lagoon Park Acquisiton". TO ORDINANCE NO.8719 ORDINANCE NO. 8972 AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE N0. 8719 ADOPTED-OCTOBER 26, 1977, THE SUMMARY GRANT APPROPRIATION ORDINANCE, AS AMENDED; BY ESTABLISH- ING A NEW TRUST AND AGENCY FUND ENTITLED:"BLUE LAGOON PARK ACQUISITION", AND APPROPRIATING FUNDS FOR THE PURPOSE OF SAME IN THE AMOUNT OF $688,410; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND DISPENSING WITH THE REQUIRE- MENT OF READING SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION. WHEREAS-, the. City Commission adopted Ordinance No. 8719 on October 2 i, 1977, establishing resources and appropriations for gz;,a7 t.,nds anticipated by the City of Miami, Florida, and for come p-nnding City matching funds; and :WHEREAS, the Florida Department of Natural Resources, on behalf of the U.S. Department of Interior, has recommended that rlrr pity of Miami be granted an award of $333,410`of Federal Land and Water Conservation monies to assist in the purchase of approximately 3.4 acres of land along the southern shoreline of Tamiami Canal and Blue Lagoon for development of a neighborhood park; and WHEREAS, the Florida Department of Natural Resources requires a dollar -for -dollar cash match for the aforementioned' grant award; and WHEREAS, the additional sum of $21,590: is required to cover the costs of legal fees and administrative expenses related to the acquisition of the land, thus increasing the City of Miami's contribution to $155,000; WHEREAS, a sum of $355,0.00 for the implementation of the above program has been identified within the Parks for People Bond fund and can be transferred as follows: (1) Remain- ing Park D.Lstrict VIII Improvements--$90,000; (2) West End Park--$65,000; and (3) Bayfront Park Landfill7-$200,000; and WHEREAS, a Trust and Agency Fund is required to identify this capital project as funded in part by a grant and the Capital Improvement Appropriation Ordinance (8716) will be amended to incorporate this project within the Capital Projects Fund; r-N NOW, TIIEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY. OF MIAMI, FLORIDA; Section 1. Section 1 of Ordinance No. 8719, adopted October 26, 1977, as amended, is hereby further amended in the 1/ following particulars; "Section 1.
