HomeMy WebLinkAboutO-09050ORDINANCE NO. 90 i 0 AN ORDINANCE AMENDING ORDINANCE NO. 6871, THE COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF MIAMI, BY CHANGING THE ZONING CLASSI- FICATION OF LOT 18, BLOCK 17; WYNWOOD PARK (5-23), BEING APPROXIMATELY 229 N.W. 30TH STREET, FROM R-3 (LOW DENSITY MULTIPLE) TO PR (PUBLIC PARK AND RECREATIONAL USE), AND BY MAKING THE NECESSARY CHANGES IN THE ZONING DISTRICT MAP MADE A PART OF SAID ORDINANCE NO. 6871 BY REFERENCE AND DESCRIPTION IN ARTICLE III, SECTION 2, THEREOF; BY REPEALING ALL ORDINANCES, CODE SECTIONS, OR PARTS THEREOF IN CONFLICT; AND CONTAINING A SEVERABILITY CLAUSE. WHEREAS, the Miami Planning Advisory Board, at its meeting of October 3, 1979, Item No. 2(a), following an advertised Hearing, adopted Resolution No. PAB 58-79 by a 7 to 0 vote recommending a change of zoning classification as hereinafter set forth; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 6871, the Comprehensive Zoning Ordinance for the City of Miami, be and the same is hereby amended by changing the zoning classification of Lot 18, Block 17; WYNWOOD PARK (5-23), being approximately 229 N.W. 30th Street, from R-3 (Low Density Multiple) to PR (Public Park and Recreational Use), and by making the necessary changes in the zoning district map made a part of said Ordinance No. 6871, by reference and description in Article III, Section 2 thereof. Section 2. That all laws or parts of laws in conflict herewith be and the same are hereby repealed insofar as they are in conflict. Section 3. Should any part or provision of this Ordinance be declared by a Court of competent jurisdiction to be invalid, the same shall not affect the validity of the Ordinance as a whole. To allow the development of Wynwood Mini -Park. Land use on the north side of NW 30th Street, adjacent to the park is residential. On the block south of the park, a housing, for the elderly project is programmed for the west end and the Wynwood Community Center occupies the east end. Opposite the Community Center, on the east side of NW 2nd Avenue is a parking lot for the Center. Buena Vista Elementary School is. also located on the east side of NW 2nd Avenue, north of NW 30th Street. Zoning is R-3 immediately adjacent to the park on the north side of NW 30th Street and R-2 north of the park. Zoning on the south side of NW 30th Street is C-5. On the west side of NW 2nd Avenue, zoning is C-2. 'c� ANALYSIS: RECOMMENDATION: PLANNING DEPARTMENT: This 7,150 square foot mini -park is designed to accommodate two age groups: a) an elderly age group can make use of a sheltered picnic and table games area while b) an adolescent age group can make use of the play lot.. Appropriate paving and landscaping is included. The design and construction budget is $50,000 from CD funds. APPROVAL of both (a) and:(b) subject to site plan approval.
