AN ORDINANCE AMENDING ORDINANCE NO. 6871,
THE COMPREHENSIVE ZONING ORDINANCE FOR THE
CITY OF MIAMI, BY CHANGING THE ZONING
CLASSIFICATION OF LOTS 34 AND 35 AND A
PORTION OF LOT 33, LESS ANY DEDICATIONS FOR
STREET PURPOSES; JACKSON PEACOCK'S SUB (4-71),
BEING APPROXIMATELY 3117 BIRD AVENUE, FROM R-3A
(LOW DENSITY APARTMENT) TO C-1A (PLANNED SHOPPING
CENTER DISTRICT), AND BY MAKING THE NECESSARY
CHANGES IN THE ZONING DISTRICT MAP MADE A PART
OF SAID ORDINANCE NO. 6871 BY REFERENCE AND
DESCRIPTION IN ARTICLE III, SECTION 2, THEREOF;
BY REPEALING ALL ORDINANCES, CODE SECTIONS, OR
PARTS THEREOF IN CONFLICT; AND CONTAINING A
SEVERABILITY CLAUSE.
WHEREAS, the Miami Zoning Board, at its meeting of
September 10, 1979, Item No. 8, following an advertised Hearing,
adopted Resolution No. ZB 172-79 by a 7 to 0 vote recommending
a change of zoning classification. as hereinafter set forth; and
WHEREAS, the City Commission, after careful consideration
of this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Ordinance No. 6871, the Comprehensive
Zoning Ordinance for the City of Miami, be and the same is hereby
amended by changing the zoning classification of Lots 34 and 35 and
a portion of Lot 33, less any dedications for street purposes;
JACKSON PEACOCK'S SUB (4-71), being approximately 3117 Bird Avenue,
from R-3A (Low Density Apartment) to C-1A (Planned Shopping Center
District), and by making the necessary changes in the zoning district
map made a part of said Ordinance No. 6871, by reference and
description in Article III, Section 2, thereof.
Section 2. That all laws or parts of laws in conflict
herewith be and the same are hereby repealed insofar as they are in
conflict.
Section 3. Should any part or provision of this
Ordinance be declared by a Court of competent jurisdiction to be
invalid, the same shall not affect the validity of the Ordinance as
a whole.

REQUEST A Change of Zoning Classification from 'R-3A
(Low Density Apartments) to C-1A (Planned
Shopping Center District)
EXPLANATION Owners of the business on this site are
seeking this change in order to improve
said business (Scotty's Meat Market & Grocery
Store). The area under consideration has
21,308 square feet.
RECOMMENDATION APPROVAL. The C-1A (Planned' Shopping Center)
district is specifically intended for
PLANNING locations where there is a need for con -
DEPARTMENT trolling the design of the Center in order to
protect the nearby residential areas. The
proposed rezoning to C-1A is consistent
with the Comprehensive Neighborhood Plan and
will allow the expansion of an existing C-1A
District. Since the property under petition
has street frontage on Bird Avenue, an
arterial street, access can be restricted to
this frontage in order to protect the existing
residential, neighborhood.
ZONING BOARD Recommended approval on September 10, 1979.
CITY COMMISSION APPROVED on 1st reading, October 30, 1979.
