HomeMy WebLinkAboutO-09044ORDINANCE NO. 9044 AN ORDINANCE AMENDING ORDINANCE NO. 6871, THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF MIAMI, BY CHANGING THE ZONING CLASSIFICATION OF THE W 1/2 OF LOT 21 AND ALL OF LOT 22, BLOCK 28, FROW HOMESTEAD AND (B-106). BEING APPROXIMATELY 3400-3410 GRAND AVENUE FROM R-CC (RESIDENTIAL OFFICE) TO PR (PUBLIC PARK AND RECREATIONAL USE), AND BY MAKING THE NECESSARY CHANGES IN THE ZONING DISTRICT MAP MADE A PART OF SAID ORDINANCE NO. 6871 BY REFERENCE AND DESCRIPTION IN ARTICLE III, SECTION 2, THEREOF; BY REPEALING ALL ORDINANCES, CODE SECTIONS, OR PARTS THEREOF IN CONFLICT; AND CONTAINING A SEVERABILITY CLAUSE. WHEREAS, the Miami Planning Advisory Board. at its meeting of September 5, 1979, Item No. 4(a), following an advertised Hearing, adopted Resolution No. PAB 46-79 by a 4 to 0 vote ( 3 members absent) recommending a change of zoning classification, as hereinafter set forth; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 6871, the Comprehensive Zoning Ordinance of the City of Miami, be and the same is hereby amended by changing the zoning classification of the W 1/2 of Lot 21 and all of Lot 22, Block 28, FROW HOMESTEAD AHD (B-106), being approximately 3400-3410 Grand Avenue from R-CC (Residential Office) to PR (Public Park and Recreational Use), and by making the necessary changes in the zoning district map made a part of said Ordinance No. 6871, by reference and description in Article III, Section 2, thereof. Section 2. That all laws or parts of laws in conflict herewith be and the same are hereby repealed insofar as they are in conflict. Section 3. Should any part or provision of this Ordinance be declared by a Court of competent jurisdiction to be invalid, the same shall not affect the validity of the Ordinance as a whole. PARK AND RECREATIONAL USE. and b) Request for permission to construct and operate recreational facilities Coconut Grove Mini -Park - per ARTICLE XVIII-I PUBLIC PARK AND RECREATIONAL USE - PR DISTRICT, Section 4(1-3) on above site zoned R-CC Residential Office proposed to be rezoned to PR -Public Park'and Recrea- tional Use District, per plan on file. To allow the development of Coconut Grove Mini -Park. Across Grand Ave. are 2-story apartment buildings; west are stores, and on the east, a funeral home. Acquisition and development of this Park was identified in the 3rd and 4th Year Community Development Block Grant applications, supported by the Coconut Grove Community Development Task Force. Acuisition has been completed through a "quick take" procedure. This 7,500 square foot mini -park is visualized as an adult passive park and is programmed for checker tables and shelters, barbeque pit:, benches paved areas and landscaping. The Coconut Grove Community Development Task Force has reviewed the site plan and approved the inclusion of the barbeque pit and an optional water feature. (See attachment) Funding is from the '3rd and 4th Year Community Development Block Grant in the amounts of $58,000 and $3G,000 respectively. Approval, subject to site and development plan. approval.
