AN ORDINANCE AMENDING ORDINANCE NO. 6871, THE
COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF
MIAMI BY DELETING SUB -SECTIONS (136-B), (137-B),
AND (169) FROM ARTICLE XXV BASE BUILDING LINES,
SECTION 1, AND RE -NUMBERING SUBSEQUENT SUB -SECTIONS
(136-C), (137-C) (137-D) AND (169-A) TO (136-B)
(137-B), (137-C) AND (169), RESPECTIVELY, IN ARTICLE
XXV BASE BUILDING LINES, SECTION 1; REPEALING ALL
ORDINANCES, CODE SECTIONS OR PARTS THEREOF IN CON-
FLICT INSOFAR AS THEY ARE IN CONFLICT; AND CONTAINING
A SEVERABILITY PROVISION.
WHEREAS, the Miami Planning Advisory Board, at its
meeting of September 19, 1979, Item No. 4, following an advertised
Hearing, adopted Resolution No. PAB 55-79 by a 7 to 0 vote recommend-
ing amendments to Ordinance No. 6871, ARTICLE XXV, BASE BUILDING LINES,
Section 1, as hereinafter set forth; and
WHEREAS, the City Commission after careful consideration
of this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this Ordinance Amendment,
as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Ordinance No. 6871, the Comprehensive Zoning
Ordinance for the City of Miami, be and is hereby amended by
deleting Sub -sections (136-B), (137-B) and (169) from ARTICLE XXV,
BASE BUILDING LINES, Section 1.
Section 2. Ordinance No. 6871, the Comprehensive Zoning
Ordinance for the City of Miami, be and is hereby amended as follows:
ARTICLE XXV, BASE BUILDING LINES, Section 1
Subsequent Sub -sections (136-C), (137-C),
137-D) and (169-A) are renumbered to
(136-B), (137-B), (137-C) and (169), respectively.
Section 3. That all laws or parts of laws in conflict
herewith be and the same are hereby repealed insofar as they are in
conflict.
Section 4. Should any part or provision of this
Ordinance be declared by a Court of competent jurisdiction to
be invalid, the same shall not affect the validity of the Ordinance
as a whole.

To eliminate reference to Clark Court and Del Monde Street
vnhich have been vacated and to Poinciana Avenue which
is otherwise referenced.
All streets in the City of. Miami, not otherwise
. designated in the Comprehensive Zoning Ordinance have
minimum zoned street widths of 50 feet and the base.
building line is located at a minimum of 25 feet from
the official center line, as determined by the Depart-
ment of•Public Works. Both. Clark Court and Del Monde
Street, which were among the designated exceptions
to this minimum requirement have been vacated through
Resolution 79-103 dated February 22, 1979, and Resolu-
tion 79-387 dated May 24, 1979 which accepted a
re -platting for the. Jamestown Center. Poinciana Avenue
was erroneously designated as an exception even though
the exception conforms to the minimum requirement. Deletion
of the reference to Poinciana Avenue will eliminate a
confusing duplication and will not change the zoned street
width or base building lines for Poinciana Avenue.
