AN EMERGENCY ORDINANCE AMENDING S?J 2ION 1 OF
ORDINANCE NO. 8719, ADOPTED OCTOBER 26, 1977,
ESTABLISHING ANEW TRUST AND ACHY FUND ENTITLED:
"KWANZA FESTIVAL-3RD YEAR"; BY INCREASING APPRO-
PRIATIONS BY $39,237 FROM $72,600 TO $111,837;
SAID APPROPRIATIONS TO BE FUNDED FROM THE FINE
ARTS COUNCIL IN THE AMOMIT OF $12,600, METROPOLITAN
DADE COUNTY IN THE AMOUNT OF $25,000, CITY OF
MIAMI IN THE AMOUNT OF $25,000, NATIONAL ENDOWMENT
FOR THE ARTS IN THE AMOUNT OF $7,500, AND GATE
RECEIPTS IN THE AMOUNT OF $41,737; CONTAINING A
REPEALER PROVISION; A SEVERABILITY CLAUSE; DIS-
PENSING WITH THE REQUIREMENT OF READING THE SAME
ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN
FOUR FIFTHS (4/5's) OF THE MEMBERS OF THE CITY
COMMISSION.
WHEREAS, the City Commission adopted Ordinance No. 8719 on October 26,
1977, establishing resources and appropriations for grant funds anticipated
by the City of Miami for corresponding City cash -match requirements; and
the City Cannission adopted Ordinance No. 9006 on October 17,
1979, establishing a New Trust and Agency Fund for the 3rd year Kwanza
Festival; and
WHEREAS, the Department of Leisure Services, Cultural Division, in
conjunction with the Kwanza Festival Cattnittee of South Florida, has planned
a county -wide Kwanza Festival (hereinafter referred to as "Kwanza Festival
(3rd year)', to be conducted primarily December 26, 1979 through January 1,
1980, relating to Afro-American heritage; and
WHEREAS, the Fine Arts Council of Florida has made an award to the City
in support of Kwanza Festival (3rd year), in the amount of $12,600; and
WHEREAS, Metropolitan Dade County has awarded $25,000 from Tourist Bed
Tax monies to the City in support of Kwanza Festival (3rd year), based on
an equal canbined catinitment fran the City and the Fine Arts Council of
Florida; and
WHEREAS, funds have been provided for in the Fiscal Year 1979-80
Budget, Special Programs and Accounts, Matching Funds, for Kwanza in the
amount of $25,000 to support Kwanza Festival (3rd year); and.
WHEREAS, it is anticipated that camnunity support will be in the form
of in -kind contributions and endorsements from the Urban League of Greater
Miami, Dade County Community Relations Board, United Negro College Funds
(Area Office), Pepsi Cola Bottling Company of, Miami, Black Cultural Arts
Alliance (representing over 30 Afro-American arts organizations throughout
southeastern United States), Cultural Advisory Council of Overtawn, Miami
Black Archives, History & Research Center, Inc., Progressive Firefighters
of Dade County, Performing Arts for Camnunity and Education, Inc. (P.A.C.E.),
National Artists Management (NY), Olatunji Center for African Studies (NY) ,
Junior Black Academy of Arts and Letters (Dallas,TX), James E. Scott
Cammtmity Association, Utopia Arts, Inc., Miami Times Newspaper, Dade
Black Tennis Club, Black Bowling League of Dade, Theatre of Afro -Arts,
"M" Ensemble, Caribbean -American Dance Canpany, Greater Miami Mass Choir,
Martin Luther King Boulevard Association, Universal Real Estate, Florida
State Representative Carrie Meek, Senator Richard Stone, Dade County Council
of Arts & Sciences, Dade County Tourist Development Authority, Black Arts
Workshop of Coconut Grove, Itiami-Dade Chamber of Cam<nerce, Nichols Community
of Performing Arts, Coconut Grove Children's Theatre, Miami Courier Newspaper,
and various fraternities and sororities; and
WHEREAS, it is anticipated that gate revenues will equal or exceed
$41,737; and
MiEREAS, the activities of Kwanza have been established by a camauuty-
based advisory cannittee known as "Kwanza Festival Committee of South
Florida;" and
WHEREAS, this oatmittee has agreed on activities for the Kwanza Festival
for the month of December, 1979; and
WHEREAS, an energency exists due to the timing of the activities; and
WHEREAS, the only City Camnission Meeting for December, 1979 is being
held on the 27th of December;
Nana, THEREFORE, BE IT ORDAINED BY THE COMISSION OF THE CITY OF MIAMI,
FIARIDA:
.Section 1. Section 1 of Ordinance No. 8719, adopted October 26, 1977,
the Grant Stay appropriations ordinance, as amended, is hereby further

amended in the following particulars:

Section 2. All ordinances or parts of ordinances insofar as they
are inconsistent or in conflict with the provisions of this ordinance
are hereby repealed.
Section 3. If any section, part of section, phrase, paragraph,
clause, or word of this ordinance is declared invalid, the remaining
provisions of this ordinance shall not be affected.
Section 4. This ordinance is hereby declared to be an emergency
measure on the grounds of urgent public need for the preservation of
peace, health, safety and property of the City of Miami, and upon the
further ground of the necessity to make the required and necessary
payments to its employees and officers, payment of its contracts, payment
of interest and principal on its debts, necessary and required purchases
of goods and supplies, and to generally carry on the functions and
duties of its municipal affairs.
Section 5. The requirement of reading this ordinance on two separate
days is hereby dispensed with by a vote of not less than four -fifths of
the members of the Commission.

The attached ordinance proposes to modify the budget for the third
(3rd) year Kwanza Festival by increasing the appropriation from $72,600
to $111,837 an increase of $39,237.
The Kwanza Festival, which is an Afro-American festival based on the
traditional African harvest celebration, is a time for rejoicing and giving
thanks and for enjoying the blessings of working together for the total
benefit of the entire community and family. Tothis end, a program was
designed by the Leisure Services Department, utilizing $72,600 from various
sources to celebrate this occasion. As the programming evolved with the
advice of the Kwanza Festival Committee of South Florida, it was deter-
mined that various adjustments to the budget would have to be made to
achieve the goals of the program, and expectations of the community. Most
of the adjustments ($24,964) are due to the increased costs of Obtaining
performing talents, which are at a premium during the peak season of the
year. The other increases are due to advertising and promotion for
scheduled events and the technical assistance necessary to conduct major
performing arts programs.
No additional funds will be required of the City. Funding for the
additional expenses will be offset by the revenues that will be generated
fram a major concert that will be held in the Miami Beach Convention Center
December 31, 1979. This concert will attract a minimum of 3,500 people and
produce revenues of at least $35,000.
It is suggested that the ordinance beplaced on the City Commission Agenda
as an emergency item December 27, 1979. The emergency request is necessitated
by the timing of the Kwanza events which are scheduled for the month of
December, 1979.
