HomeMy WebLinkAboutR-80-00251/7/80 CM RESOLUTION NO. 8 0 2 5 RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE A SPECIAL WARRANTY DEED TO THE STATE OF FLORIDA FOR THE CITY'S INTERAMA PROPERTY, ACCEPT FROM THE STATE OF FLORIDA ON BEHALF OF THE CITY OF MIAMI A WARRANT FOR $8.0 MILLION IN PAYMENT THEREOF, EXECUTE AN fi1REEMENT ACKNOWLEDGING THE LIMITATIONS OF USE OF SAID FUNDS AND ABROGATING THE MARCH 15, 1973 AGREEMENT BETWEEN THE CITY OF MIAMI AND THE INTERAMERICAN CENTER AUTHORITY; FURTHER AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE A SUBLEASE WITH THE FLORIDA STATE BOARD OF REGENTS FOR 14.9 ACRES OF THE ABOVE MENTIONED PROPERTY FOR THE PURPOSE OF BUILDING A MARINA: AND APPROVING CONFIRMING AND RATIFYING THE CITY MANAGERS APPLI- CATION TO THE STATE DEPARTMENT OF NATURAL RESOURCES FOR THE LEASING OF 23.6 ACRES OF STATE BAY BOTTOM LAND FOR A MARINA; WHEREAS, the City of Miami on May 13, 1960 agreed to sell the 1700 acre "Graves Tract" to the InterAmerican Center Authority for an $8.5 million vendors lien; and WHEREAS, the latest agreernent signed on March 15, 1973 provided Miami with a Quit Claim Deed for 92.6 acres of Interama Property to be held as security; and WHEREAS, that agreement provided for payments to Miami of $300,000 semi annually including principal and interest,' to begin on January 1, 1977; and WHEREAS, no payments have ever been made to Miami for any part of the Graves Tract; and WHEREAS, the City's land at Interama had an appraised value of $13,538,000 in 1972; and WHEREAS, the City of Miami is rightfully due over $10 million` including principal and interest under the March 15, 1973 agreement; and WHEREAS, the 1979 Legislature has approved an $8.0 million payment to Miami in exchange for all rights,' title and interest in the property; and WHEREAS, the Miami City Commission voted on July 23, 1979 to authorize the City Manager to proceed with the acc p �fof(E '0 million; "D0CU and ITEM NO. ►� WHEREAS, the City Commission further instructed the City Manager to seek the removal of the restrictions on the use of said $8.0 million as well as discussing other monies owed to Miami by the State of Florida; and 80-25 WHEREAS, the City Manager has discussed with officials of the State of Florida a method of replacing some of the lost value resulting from transferring the City property to the State of Florida; and WHEREAS, those discussions led to a proposed economic oppor- tunity available only to the City of Miami that would provide for a Public Marina at the North end of Biscayne Bay; and WHEREAS, Revenues from said Marina would be shared equally with the Florida International University through the State Board of Regents in consideration of the Sublease of 14.9 acres of land; and WHEREAS, several outstanding Marina and boating experts and authorities have depicted a shortage of Marina W t Storage Slips in Biscayne Bay; and WHEREAS, the Proposed Marina site is ideally located near the Intercoastal'Waterway with nearby power boat access to the Alantic Ocean; and WHEREAS, the public Marina can be built and operated by a management contract and financed with Revenue Bonds; and WHEREAS, the Proposed Marina will also provide for the Miami -Dade Community College Oceanographic Research Vessel and Waterfront Activities of the Florida International. University; and WHEREAS, the revenues earned by Miami from this opportunity will in part replace the value lost in transferring the City's Interama property to the State of Florida; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby Authorized and Directed to Execute a Special Warranty Deed transferring all rights, title and interest in the City's Property (being a portion of that land also known as the "Grave Tract") to the Board of Trustees of the Internal Improvement Trust. Fund and to accept a Warrant from the State of Florida in the amount of $8.0 million representing payment to the City of Miami for title to the 92.6 acres of property located at the former site of Interama. Section 2. The City Manager is hereby Authorized and Directed to execute an agreement that voids the March 15, 1973 Agreement between the InterAmerican Center Authority, now dissolved, and the City of Miami and provides that the City will use the $8.0 million payment described in Section 1 above for -2- 80-25 the purposes stated in Section 125.0104 (5) (a), Florida Statutes as required by the Florida Legislature. Section 3. The City Manager is hereby authorized and directed to execute a Sublease with the Florida Board of Regents for 14.9 acres of the above described property for the purpose of building a Marina. Section 4. The action of the City Manager in making appli- cation to the Department of Natural Resources on December 19, 1979, for a lease for 23.6 acres of State Submerged Land adjoining the above described property for the purpose of building a Marina is hereby approved, confirmed and ratified and he is hereby further authorized to proceed with the steps necessary to obtain all of the approvals needed to qualify for such a lease. Section 5. The City Manager is instructed to periodically advise the City Commission of the progress of the Marina proposal. PASSED AND ADOPTED this 10 day of January , 1980.
