AMENDMENT NO. 1 TO ORDINANCE NO. 9019
ORDINANCE NO. 9056
AN EMEGENCY ORDINANCE AMENDING SECTION 1 OF
ORDINANCE NO. 9019, ADOPTED NOVEMBER 8, 1979, THE
CAPITAL IMPROVEMENT APPROPRIATIONS ORDINANCE FOR
THE FISCAL YEAR ENDING SEPTEMBER 30, 1980; BY
APPROPRIATING FROM THE BUILDING AND VEHICLE
MAINTENANCE DEPARTMENT, HEAVY EQUIPMENT
MAINTENANCE, RETAINED EARNINGS, AN AMOUNT OF
$400,000 FOR THE NEW CITY ADMINISTRATION BUILDING
OFFICE FURNISHINGS; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE; AND
DISPENSING WITH THE REQUIREMENT OF READING THE
SAME ON TWO(2) SEPARATE DAYS BY A VOTE OF NOT
LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE
COMMISSION.
WHEREAS, the City Commission adopted Ordinance No. 9019 on
November 8, 1979, establishing resources and appropriations for the
implementation of capital improvements in the City of Miami, Florida for
the Fiscal Year ending September 30, 1980; and
WHEREAS, a bid has been received from Central Stationers,
Inc., for the purchase of office furnishings for the New City
Administration Building; and
WHEREAS, said bid specifies an amount of $400,000 to fund the
cost of the aforementioned furnishings; and
WHEREAS, an amount of $400,000 was approved for the New City
Administration Building Furnishings in the 1979-85 Capital Improvement
Program; and
WHEREAS, an amount of $400,000 is available from Building and
Vehicle Maintenance Department, Heavy Equipment Maintenance Division,
Retained Earnings, to fund said furnishings;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Section 1 of Ordinance No. 9019, adopted November
8, 1979, is hereby amended in the following particulars:i/

Section 2. The herein $400,000 apptopriation trans-
fer is to meet the cost of the New City Administration Building
office furnishings.
Section 3. All ordinances or parts of ordinances
insofar as they are inconsistent or in conflict with the pro-
visions of this ordinnace are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase, or word of this ordinance is declared invalid,
the remaining provisions of this ordinance shall not be affected.
Section 5. This ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further ground of the necessity to make
the required and necessary payments to its employees and offi-
cers, payment of its contracts, payment of interest and prin-
cipal on its debts, necessary and required purchases of goods
and supplies, and to generally carry on the functions and duties
of its municipal affairs.
Section 6. The requirement of reading this ordinance
on two separate days is hereby dispensed with by a vote of not
less than four -fifths of the members of the Commission.
PASSED AND ADOPTED this 10 day of January, 1980.

Appropriation for New
City Administration
Building Furnishings
The Department of Building and Vehicle Maintenance has requested an
ordinance appropriating $400,000 from Heavy Equipment Maintenance
Division, Retained Earnings, into the Capital Improvement Fund for the
cost of New City Administration Building furnishings.
Per the attached analysis from the Department of Building and Vehicle
Maintenance, total available retained earnings as of 9/30/79 were
$1,961,731. Of this amount $638,431 is required to fund FY '79-80 budget
deficits and fleet equipment purchases leaving a balance of $1,323,300.
Of this amount $923,300 is proposed to be appropriated for Motor Pool
Equipmmcnt purchases and the remaining balance of $400,000 is available
to purchase furniture for the new Administration Building. It is
understood that the $400,000 will be replaced at a later date.
Invitations to bid on the furnishings were sent to 18 potential
suppliers. One bid, from Central Stationers, Inc. for $400,000 was
received on August 16, 1979. tlr. A. L. Mullins, Purchasing Agent,
informs us that he has a verbal agreement from the bidder to extend the
effective period for the bid until December 31, 1979.
The attached proposed ordinance has been written as an emergency inasmuch
as a purchase order cannot be issued for the furnishings until the
legislation appropriating the funds has become effective.
This ordinance has been prepared for the December 27, 1979, City
Commission meeting.
