HomeMy WebLinkAboutO-09053ORDINANCE NO. 9 0 5 3 AN ORDINANCE ESTABLISHING RATES AT ON -STREET METERS AND OFF-STREET METERS AND DECAL RATES IN LOTS WHERE DECALS ARE SOLD, AS LISTED HEREIN, AND ESTABLISHING RATES AT MUNICIPAL PARKING GARAGES NO. 1, 3, AND 4; PROVIDING FOR AN EFFECTIVE DATE; RATIFYING AND CONFIRM- ING ALL ACTS OF THE OFF-STREET PARKING BOARD AND ITS DIRECTOR AS TO RATES HERETOFORE CHARGED; PROVIDING THAT THE DIRECTOR SHALL CAUSE CERTIFIED COPIES TO BE FILED PURSUANT TO SECTION 503 OF THE TRUST INDENTURE; CON- TAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the Off -Street Parking Board of the City of Miami on November 14, 1979 instructed the Director to submit an ordinance to the City Commission, upon recommendation of the Parking Consultant, that parking rates be increased in on -street parking areas, off-street park- ing areas, that decal rates be increased in all lots where decals are sold, as listed herein, and that the rates at Municipal Parking Garages No. 1, 3 and 4 be revised; and WHEREAS, the Parking Consultant has inspected the off-street parking facilities and carefully reviewed the existing rate structure; and WHEREAS, the Parking Consultant has submitted a report, dated October 15, 1979, recommending the increase in rates in on -street areas and off-street parking facilities, to be effective February 1, 1980; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The rates, as provided in this Ordinance, shall be effective at 12:01 a.m. on February 1, 1980. Section 3. All acts of the Off -Street Parking Board and its Director as to rates heretofore charged are hereby ratified and confirmed. Section 4. All Ordinances or parts thereof in conflict herewith are repealed insofar as they are in conflict. Section 5. The Director of Off -Street Parking shall cause certified copies of this Ordinance to be filed pursuant to Section 503 of the Trust Indenture. Section 6. If any section, sentence, clause, phrase, or word of this ordinance is for any reason held or declared to be unconstitutional, inoperative or void, such holding or invalidity shall not affe::t the remaining portions of this ordinance; and it shall be conFtrued to have -2- 9053 ric 4 been the intent of the Commission of the City of Miami to pass this ordinance without such unconstitutional, invalid, or inoperative part therein; and the remainder of this ordinance, after the exclusion of such part or parts shall be deemed and held to be as valid as if such parts had not been included therein. L Baw �� ��`'�`� Draft of Proposed City Commission Director Ordinance Department of Off -Street Parking 30 lY. 4 • n . s November 30, 1979 Rate Increases at Municipal Parking Facilities and Meters After careful analysis of our increased operating costs, our Parking Consultant recommended to the Off -Street Parking Board that certain increases in parking rates be implemented and the Off -Street Parking Board accepted those recom- mendations. As background for those proposed increases, we are listing below a sampling of the prices being charged in the vicinity of our facilities: Parking Garage No. 1, 40 NW 3 Street: The parking lot adjacent to this garage charges 75 per half hour ($1.50 per hour) and the maximum all day rate is $4.50. Our proposed increases would be from 40c to 50t hourly and from $2.00 to $2.25 maximum 7 a.m. to 6 p.m. (all day). Parking Garage No. 3, 90 SW 1 Street: The parking lot adjacent to this garage charges $1.00 per hour, the parking lot across the street charges $1.00 per half hour, and the parking garage across the street from our facility charges 75 per half hour ($1.50 per hour), $4.50 maximum and $50.00 per month. Our proposed increases for this facility would also be from 40c to 50c per hour, from $2.00 to $2.25 all day and from $30.00 to $35.00 per month. Parking Garage No. 4, 190 NE 3 Street: The nearest lots east and west of this facility are charging 60c per half hour, 50c per half hour and 45c per half hour, with maximums of $3.00 and $3.50. Again, our proposed rates in Garage No. 4 would be from 40c per hour to 50c per hour and the daily (7 a.m. 6 p.m.) maximum from $2.00 to $2.25. Ail on -street and off-street, hourly and monthly, rates we propose are well below those being charged at nearby parking areas. We feel that these are modest increases and will help to defray the increased costs of operating these facilities. Please make the necessary arrangements so that this proposed ordinance will be placed on a City Commission agenda for the earliest possible date, to enable the rates to become effective February 1, 1980.
