(1) You must declare that the City of Miami has been

COMPETING EVENT(S) SHALL BE SCHEDULED AT ANY. CITY FACILITY
SIXTY (60) DAYS PRIOR TO AND SIXTY (60) DAYS ASTER A
SIMILAR OR COMPETING EVENT, AS DETERMINED BY/THE CITY
MANAGER, WITH THE EXCEPTION OF EXISTING CONTRACTUAL OBLI-
GATIONS; SAID POLICY BEING SUBJECT TO -WAIVER BY THE CITY
COMMISSION. f`

Facilities
ttached plea'e find proposed Resolution establishing a city-wide
licy.that could prohibit the scheduling of similar or ~competing
ev •ts _ ity facilities sixty days beforeand sixty days after
a similar or competing event. In order to lawfully, adopt such
a policy this this° Commission must make certain factual :determinations
as outlined in the attached copy of memo of November 21, 1979.
We also attach copy of memo dated June. 21, .,1979, . `that briefly

Succintly, it appears that the >City of Miami has the power to determine
that an individual may be entitled to a "buffer zone" or "protection
period" surrounding events held at a municipal facility. If you
would choose to do so, you must make the following .Findings upon
the record in order to avoid liability under the various' anti-trust
acts:
(1) You must declare that the City of Miami has been
granted immunity from' the anti-trust acts by virtue of its Home Rule
status.
(2.)' You must "find that the. holdi g of two events at two.

time period, would resulL in severe economic harm TO THE CITY:
