Attached are letters of intent from the applicant for Biscayne ,
Federal Plaza 1st Addition, T.P. #1068, as called for in Zoning
Board resolution ZB-252-79, December 17, 1979.
Because of the proximity of the existing trees to the curb along
the easterly side of N.E. 2 Ct., it is not feasible to relocate
the curb without relocating or destroying the trees. The applicant
has requested that they be allowed to move the. curb and gutter and
widen the pavement on the westerly side of N.E. 2 Ct., instead of.
the easterly side. This department's staff has reviewed this request,
and finds that this would be an acceptable alternative to condition
"A" of the Zoning Board resolution. All other conditions will be
accomplished by the applicant as required.
We request that this item be scheduled on the informal agenda for
the Zoning Board meeting of January 14,. 1980 for discussion and
possible amendment.of the previous Z.B. resolution. The one objector
present at the Z.B. meeting of December 17, 1980 has been notified
of this change by the applicant.

Dear Mr. Cather:
At the public hearing before the City of Miami Planning Board on Monday
evening, December 17, 1979, unanimous approval was granted for the vacation
and closure of the alleys in Block 5 of MIRAMAR (5-4) in conjunction with
Tentative Layout, subject to conditions A, B, C, and D of Resolution No.
ZB-252-79, a copy of which is attached hereto.
We prepared a "Letter of Intent" accepting the conditions set forth in the
resolution and forwarded it to the First Church of Christ, Scientist for
examination and approval by the Board of Trustees.
They have responded with a separate letter, copy of which is attached hereto,
agreeing to all of the conditions except "A" which would involve the des-
truction of several beautiful large shade trees in the East Parkway of
N.E. Second Court. They have suggested that the curb and gutter on the West
side be moved Westward about four feet to correspond with the alignment of
the existing curb and gutter on the Grand Union Parcel extending from
Biscaynd.Federal's North property line to N.E. 19th Street.
Mr. Senerchia and Mr. Mohr made an on -site inspection and concluded that the
church's argument was valid and had merit.

Biscayne Federal accepts the suggestion made by the Board of Trustees of
the First Church of Christ, Scientist to realign the curb and gutter on the
West side of N.E. 2nd Court from N.E. 18th Street to the present curb and
gutter on the Grand Union Parcel; to remove and replant the palm tree on
the Northwest corner of the intersectioy of N.E. 18th Street and N.E. 2nd
Court; to make whatever other improvements are required according to the
City of Miami Code; all of the expenses incurred in connection with the
improvements to be paid by Biscayne Federal.
We respectfully request that you review this matter with your staff and
that you will see fit to recommend acceptance of the suggestion initiated by;
the church to accomplish the proposed widening on the West side of N.E.
2nd Court.
We shall appreciate your prompt response to this problem.
