Because of the proximity of the existing trees to the curb along the easterly side of N.E. 2 Ct., it is not feasible to relocate the curb without relocating or destroying the trees. The applicant has requested that they be allowed to move the. curb and gutter and widen the pavement on the westerly side of N.E. 2 Ct., instead of. the easterly side. This department's staff has reviewed this request, and finds that this would be an acceptable alternative to condition "A" of the Zoning Board resolution. All other conditions will be accomplished by the applicant as required. We request that this item be scheduled on the informal agenda for the Zoning Board meeting of January 14,. 1980 for discussion and possible amendment.of the previous Z.B. resolution. The one objector present at the Z.B. meeting of December 17, 1980 has been notified of this change by the applicant. P.0-43 OFMAIIIMIONOMMIO • • Si BISCAYNE FEDERAL•SAVI E. We prepared a "Letter of Intent" accepting the conditions set forth in the resolution and forwarded it to the First Church of Christ, Scientist for examination and approval by the Board of Trustees. They have responded with a separate letter, copy of which is attached hereto, agreeing to all of the conditions except "A" which would involve the des- truction of several beautiful large shade trees in the East Parkway of N.E. They have suggested that the curb and gutter on the West side be moved Westward about four feet to correspond with the alignment of the existing curb and gutter on the Grand Union Parcel extending from Biscaynd.Federal's North property line to N.E. 19th Street.
