AMENDMENT NO. 7 TO ORDINANCE NO. 9000

AN ORDINANCE AMENDING SECTIONS 2 AND 5 OF
ORDINANCE NO. 9000, ADOPTED OCTOBER 17, 1979,
THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE
FISCAL YEAR ENDING SEPTEMBER 30, 1980, AS
AMENDED; BY APPROPRIATING INTO INTERNAL SERVICE
FUNDS FROM BUILDING AND VEHICLE MAINTENANCE
DEPARTMENT, HEAVY EQUIPMENT MAINTENANCE DIVISION,
RETAINED EARNINGS, AN AMOUNT OF $1,222,899 OF
WHICH $822,899 IS TO BE TRANSFERRED TO MOTOR POOL
MAINTENANCE FOR MACHINERY AND EQUIPMENT REPLACEMENT
AND $400,000 TO THE CAPITAL IMPROVEMENT FUND FOR
FURNISHINGS FOR THE NEW CITY ADMINISTRATION
BUILDING IN ORDER TO COMPLY WITH CORRECT ACCOUNTING
PROCEDURES; CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE; AND DISPENSING WITH THE RE-
QUIREMENT OF READING SAME ON TWO SEPARATE DAYS
BY VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE
MEMBERS OF THE COMMISSION.
WHEREAS, the City Commission adopted Ordinance No. 9000 on
October 17, 1979, establishing revenues and appropriations for the City
of Miami, Florida, for the fiscal year ending September 30, 1980; and
WHEREAS, Ordinance No. 9038, adopted December 27, 1979,
appropriated a total of $923,300 from Building and Vehicle Maintenance
Department, Retained Earnings, for Motor Pool Maintenance Division,
Machinery and Equipment Replacement; and
WHEREAS, of this total, an amount of $822,899 was to be
appropriated from Heavy Equipment Maintenance Division, Retained Earnings;
and
WHEREAS, Ordinance No. 9056, adopted January 10, 1980,
appropriated $400,000 from Building and Vehicle Maintenance Department,
Heavy Equipment Maintenance, Retained Earnings, for the New City
Administration Building Office furnishings; and
WHEREAS, for accounting purposes, it is necessary to appro-
priate said Retained Earnings into the Internal Service Funds, Heavy
Equipment Maintenance Division, in order to permit the transfer of said
funds for the aforementioned purposes;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Sections 2 and 5 of Ordinance No. 9000, adopted
October 17, 1979, the Annual Appropriations Ordinance for the fiscal
year ending September 30, 1980, are hereby amended in the following
particulars:l/
"Section 2. The following activities, which
are carried on for the service and convenience
of other funds, shall be operated by the City
Manager within the limits of the appropriations
provided in the foregoing Departments, Boards,
Offices, and accounts of the City of Miami and
other revenues or receipts which may be received:

Section 5. The above appropriations are based on
the following sources of revenues for the 1979-80
fiscal year:

provisions are now in effect and remain unchanged. Asterisks indicate
omitted and unchanged material. All figures are rounded to the next
dollar.

Section 2. The amount of $1,222,899 from the Building and
Vehicle Maintenance Department, Heavy Equipment Maintenance Division,
Retained Earnings, is hereby appropriated in an amount of $822,899 for
the Motor Pool Maintenance Division Machinery and Equipment Replacement
and an amount of $400,000 for the New City Administration Building
furnishings in order to comply with correct accounting procedures.
Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of this
ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase, or word this ordinance is declared invalid, the
remaining provisions of this ordinance shall not be affected.
Section 5. The requirement of reading this ordinance on
two separate days is hereby dispensed with by a vote of not less than
four -fifths of the members of the Commission.

Ordinance No. 9038, adopted December 27, 1979, appropriated a total of
$923,300 from Building and Vehicle Maintenance Department, Retained
Earnings, for Motor Pool Maintenance Division, Machinery and Equipment
Replacement. 0f this total, an amount of $822,899 was appropriated from
the Heavy Equipment Maintenance Division.
Ordinance No. 9056 appropriated $400,000 from Building and Vehicle
Maintenance Department, Heavy Equipment Maintenance Division, Retained
Earnings, into the Capital Improvement Fund for FY 1979-80 for the New
City Administration Building furnishings.
The attached proposed ordinance has been prepared in order to ensure that
the appropriations set up by Ordinances No. 9038 and No. 9056 are made
according to correct accounting procedures. In so doing, the ordinance
appropriates the above mentioned amounts, totaling $1,222,899, from the
Heavy Equipment Maintenance Division, Retained Earnings, into the Internal
Service Funds in order to enable transfers to be made for the designated
purposes.
This ordinance has been prepared for the January 24, 1980 City Commission
meeting.
