ORDINANCE NO. 9069
AN ORDINANCE APIRNDIN(= SECTIO11 50-78 OF THE COT)
OF THE CITY OF MIAMI , FLORIDA, WHICH ESTABLISNFP
DOCKAGEFEES AT THE DINNER KEY MARINA AND DINNER
KEY MARINA ANNEX BY REPEALING SAID SECTIOM
50-78 IN ITS ENTIRETY AND SUBSTITUTING A NTT
SECTION THEREFOR AUTHORIZING THE CITY MANAGER
TO ESTABLISH D0CIA.(''E; RATES UPON CONSIDERATION
OF DESIGNATED COST FACTORS; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAT"I,
Section 1. Section 50-78 of the Code of the City of
Miami, Florida, as amended, is hereby further amended by repealing
the said Section in its entirety and substituting therefor the
following:
"The dockage rates of Pinner Keu Marina
and Dinner Key Marina Annex for all vessels
shall be annually computed and established
by the city manager upon consideration of
the following cost factors: (a) bond debts
service requirements of one hundred and
fifty percent (150%) coverage; (b) onerating
expenses; and (c) management fees of any
private management firm engaged in providing
Management services for Dinner Key Marina
and Dinner Kev farina Annex. The dockage
rates shall not exceed those charged at other
marinas of comparable quality situated on
public lands within a 50 mile radius of
Dinner Key Marina and Dinner Key marina
Annex; however, the city commission reserves
the right to authorize the city manager
to establish dockage rates in excess of
those charged at said comnarable facilities."
Section 2. All ordinances or parts of ordinances, all
resolutions or parts of resolutions, insofar as they are incon-
sistent or in conflict with the provisions of this ordinance are
hereby repealed.
Section 3. If any section, part of section, naragranh,
clause, phrase, or word of this ordinance is declared invalid,
the remaining provisions of°this ordinance shall not he affected.
