AMENDMENT NO. 8 TO ORDINANCE N0. 9000
ORDINANCE NO. 9068
AN ORDINANCE AMENDING SECTIONS 1 AND 5 OF
ORDINANCE NO. 9000, ADOPTED OCTOBER 17, 1979, THE
ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL
YEAR ENDING SEPTEMBER 30, 1980, AS AMENDED; BY
INCREASING THE GENERAL FUND IN THE AMOUNT OF
$111,000 CONSISTING OF APPROPRIATIONS OF $60,000
FOR THE DEPARTMENT OF COMPUTERS AND
COMMUNICATIONS, $37,000 FOR THE FINANCE
DEPARTMENT, AND $14,000 FOR THE SOLID WASTE
DEPARTMENT TO DEFRAY THE COSTS OF IMPLEMENTING THE
WASTE DISPOSAL FEE; DECREASING GENERAL FUND
REVENUES, TAXES, BY $2,476,000 TO PERMIT THE
APPROPRIATION OF FLORIDA POWER AND LIGHT FRANCHISE
MONIES IN THE SAME AMOUNT INTO THE CAPITAL
IMPROVEMENT FUND; BY DECREASING GENERAL
FUND,MISCELLANEOUS REVENUES, BY $653,000,
ANTICIPATED FOR FY'80 BUT RECEIVED AND ACCOUNTED
FOR IN FY'79; AND BY INCREASING GENERAL FUND
REVENUES, CHARGES FOR SERVICES, IN THE AMOUNT OF
$3,240,000 FOR THE PURPOSE OF APPROPRIATING
ANTICIPATED REVENUES FROM WASTE DISPOSAL FEES;
CONTAINING A REPEALER PROVISION AND A SEVERABILITY
CLAUSE; AND DISPENSING WITH THE REQUIREMENT OF
READING SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT
LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE
COMMISSION.
WHEREAS, the City Commission adopted Ordinance No. 9000 on October
17, 1979, establishing revenues and appropriations for the City of Miami,
Florida, for the fiscal year ending September 30, 1980; and
WHEREAS, Ordinance No. 9065, adopted January 24, 1980, provides
for the assessment and collection of a City waste disposal fee commencing
effective March 1, 1980; and
WHEREAS, said Ordinance No. 9065 provides for an assessment of
thirty-six dollars ($36.00) for the remainder of calendar year 1980, upon all
residential units and business establishments within the City who receive
sanitation services by the Department of Solid Waste, for the purpose of
partly defraying the cost of waste disposal; and
WHEREAS, it is anticipated that said assessment of fees for the
remainder of 1980 from March through December will be approximately
$3,240,000; and
WHEREAS, it is estimated that an amount of $60,000 will be required
by the Department of Computers and Communications to provide a computerized
billing system at an estimated cost of $45,000 and three (3) terminals and one
(1) printer at an estimated cost of $15,000 to be used to implement the waste
disposal fee; and
WHEREAS, implementation of the waste disposal fee will require a
personnel increase in the Department of Solid Waste of two (2) Account Clerk
positions for the remaining seven (7) months of FY '80, for a total cost of
$14,000; and
WHEREAS, an amount of $37,000 will be required by the Finance
Department for accounting services associated with implementing the waste
disposal fee; and
WHEREAS, revenues in the amount of $653,000, consisting of
$290,000 for Miami -Metro and Sewer and $363,000 for Dodge Island, anticipated
for FY'80 but received and accounted for in FY'79, will be offset by
anticipated waste disposal fees;
WHEREAS, the remainder of $2,476,000 from anticipated waste disposal
fees will be usEd to replace a similar amount of Florida Power & Light franchise
fees which will permit the reinstitution of the Capital Improvement Fund; and
WHEREAS, it is necessary to identify the source of the anticipated
General Fund revenues for the aforementioned fees by transferring the amount
of $3,240,000 from Taxes to Charges for Services;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. Sections 1 and 5 of Ordinance No. 9000; adopted
October 17, 1979, the Annual Appropriations Ordinance for the fiscal year
ending September 30, 1980, as amended, are hereby further amended in the
following particulars:l/

"Section 1. The following appropriations are made for
the municipal operations of the City of Miami, Florida,
for the fiscal year 1979-80 including the payment of
principal and interest on all General Obligation Bonds:

Section 5. The above appropriations are based on
the following sources of revenues for the 1979-80
fiscal year:

Section 2. The following steps are herein taken in order to
implement the waste disposal fee and permit the appropriation of Florida Power
and Light franchise revenues into the Capital Improvement Fund:

a) increase General Fund appropriations in the amounts of $60,000 for
the Department of Computers and Communications, $37,000 for the
Finance Department, and $14,000 for the Solid Waste Department, for
a total of $111,000, to defray the costs of implementing the waste
disposal fee;
b) decrease General Fund Revenues, Taxes, by $2,476,000 for the purpose
of reinstating Florida Power and Light franchise monies in the
same amount in the Capital Improvement Fund;
c) decrease General Fund, Miscellaneous Revenues, by $653,000,
consisting of $290,000 for Miami -Metro Water and Sewer and $363,000
for Dodge Island, anticipated for FY'80 but received and accounted
for in FY'79.
d) increase General Fund Revenues, Charges for Services, in the amount
of $3,240,000 for the purpose of appropriating anticipated revenues
from the waste disposal fee.
Section 3. All ordinances or parts of ordinances insofar as they
are inconsistent or in conflict with the provisions of this ordinance are
hereby repealed.
Section 4. If any section, part of section, paragraph, clause,
phrase, or word of this ordinance is declared invalid, the remaining
provisions of this ordinance shall not be affected.
Section 5. The requirement of reading this ordinance on two
separate days is hereby disper,;ed with by a vote of not less than four -fifths
of the members of the Commission.

Proposed Ordinance:
Implementation of Waste
Disposal Fees
Ordinance No. 9065, adopted January 24, 1980, provides for the assessment
and collection of a waste disposal fee of $36.00 upon all residential units
and business establishments within the City receiving sanitation services
from the Department of Solid Waste.
It is anticipated that the assessment of waste disposal fees for the remainder
of 1980 from March through December will total approximately $3,240,000. Costs
for implementing the waste disposal fees will total $111,000, consisting of:
1) $60,000 for the Department of Computers and Communications
to provide a computerized billing system at an estimated
cost of S45,000 and three (3) terminals and one (1) printer
at an estimated cost of $15,000;
2) $14,000 for the Department of Solid Waste for two (2) new
Account Clerk positions for the remaining seven (7) months
of FY '80 at $984 per month plus F.I.C.A.;
3) $37,000 for the Finance Department for accounting services
associated with the waste disposal fee.
It is suggested that the remaining amount of $3,129,000 be used for two purposes.
First, $653,000 is needed to offset revenues that were anticipated in FY '80 from
Dodge Island and Miami -Metro Water and Sewer, but received and accounted for in
FY '79. Second, $2,476,000 should be used to reinstitute the Capital Improvement
Program that was postponed as a result of actions taken during the adoption of
the FY '80 Budget.
This Ordinance has been prepared for the February 12, 1980, City Commission Meeting.
