HomeMy WebLinkAboutO-09071f, ' ORDINANCE N0. 9 0 "7 1 - AN ORDINANCE AMENDING CHAPTER 13 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, ENTITLED: "DOWNTOWN DEVELOPMENT", BY AMENDING ARTICLE II THEREOF, ENTITLED: "DOWNTOWN DEVELOPMENT AUTHORITY", BY AMENDING SUBSECTIONS (1) AND (3) OF SECTION 13-6 OF SAID ARTICLE, TO PROVIDE FOR AN INCREASE IN THE MEMBERSHIP OF THE DOWNTOWN DEVELOPMENT BOARD FROM SEVEN TO FIFTEEN MEMBERS AND THE STAGGERING OF THE TERMS OF OFFICE OF SAID MEMBERS; CONTAIN- ING A REPEALER. PROVISION, A SEVERABILITY CLAUSE, AND DISPENSING WITH THE REQUIREMENT OF READING THE SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION. WHEREAS, the downtown district under the jursdiction and control of the Downtown Development Authority is exper- iencing rapid economic and employment growth and physical development and redevelopment; and WHEREAS, the activities and involvement of the Downtwon Development Authority in development, redevelopment, cultural, and other downtown projects have greatly increased since the last board expansion in 1968; and WHEREAS, the board of the Downtown Development Authority on June 8, 1979 resolved to broaden community representation in the affairs of the Authority by increasing its membership; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 13-6 of Article II, entitled: "Downtown Development Authority" of Chapter 13, entitled: "Downtown Development", of the Code of the City of Miami, Florida, as 1/ amended, is hereby amended in the following particulars: "Chapter 2. Administration Article II. Downtown Development Authority. -------------------------------------------------------------- l/ Words stricken through shall be deleted. Underscored words constitute the amendment proposed. Remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. elk Sec. 13-6. Downtown development board --Composition; appointment and terms of office of members; filling of vacancies. (1) The affairs of the authority shall be under the direct supervision and control of a board con- sisting of seven fifteen members appointed by the eemm+994en-a€-#die-e#ty city commission. (3) The board shall be constituted as follows: (a) The mayor shall be chairman of the board and the seventh fifteenth member. At any time the mayor elects to relinquish his position as chairman and so signifies such election in writing, the posi- tion of chairman will be filled by one of the other €eur twelve members who shall have been appointed to the board under the provisions of subsections (b) through (e) hereof. The position will be filled in _ accordance with the rules of procedure as duly adopted by the board. - (b) Aee Three members shall be appointed, each for a term expriing ,June 30, 1966 1982. (c) 9ne Three members shall be appointed, each for a term expiring June 30, 196;L 1983. (g) One member may be nominated by the state cabinet of the state to the city commission e€-the e#ty for its approval and appointment. All ordinances or parts of ordinances in conflict herewith, insofar as they are in conflict, are hereby repealed. -2- 0fl71 i Section 3. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. Section 4. The requirements of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission.
