Home My WebLink AboutO-09077GMM/wpc 1/17/80 ORDINANCE NO, 9077 AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 8939 ADOPTED MAY 24, 1979, WHICH CHANGED THE ZONING CLASSI- FICATION OF THE EAST 29.98' OF THE WEST 177.98' OF TRACT "A" SHADY OAKS (44-20) BEING 1301 NORTHWEST 27TH AVENUE, FROM R-4 (MEDIUM DENSITY MULTIPLE) TO C-4 (GENERAL COMMER- CIAL), AND REFLECTED THE LEGAL DESCRIPTION AS "WEST 29.98' OF THE EAST 177.93' OF TRACT "A" SHADY OAKS (44-20), BY CORRECTING A SCRIVENER'S ERROR IN SAID SECTION 1, TO ACCURATELY READ: EAST 29.98' OF THE WEST 177.98' OF TRACT "A", SHADY OAKS (44-20), AND BY MAKING THE NECESSARY CHANGES IN THE ZONING DISTRICT MAPS MADE A PART OF SAID ORDINANCE NO. 6871 BY REFERENCE AND DESCRIPTION IN ARTICLE III, SECTION 2 THEREOF; BY REPEALING ALL ORDINANCES, CODE SECTIONS OR PARTS THEREOF IN CONFLICT; AND CONTAINING THE SEVERABILITY PROVISION; AND DISPENSING WITH THE REQUIREMENT OF READING THE SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 1 of Ordinance No. 8939 adopted May 24, 1979, is hereby amended in the following particulars: l/ "Section 1. Ordinance No. 6871, The Comprehensive Zoning Ordinance for the City of Miami, be and the same is hereby amended by changing the zoning classification of tdest-29;l984- oi--Last-H'i'7931 East 29.98' of the West 177.98' of Tract A Shady Oaks (44-20) being 1301 Northwest 27th Avenue from R-4 Medium Density Multiple to C-4 General Commercial and making the necessary changes in the zoning district maps made a part of said Ordinance No. 6871 by reference and description in Article III, Section 2 thereof." Section 2. The above amendment is made expressly for the purpose of correcting a scrivener's error which recited the legal description in- correctly as the West 29.98' of the East 177.93' of Tract A Shady Oaks (44-20), instead of the Fast 29.98' of the West 177.981. Section 3. All laws or parts of laws in conflict herewith be and the same are hereby repealed insofar as they are in conflict. Section 4. Should any part or provision of this Ordinance be declared by a Court of competent jurisdiction to be invalid, the same shall not affect the validity of the Ordinance as a whole. 1/ Words and/or figures stricken through shall be deleted.
