Environmental Planners 285 Sevilla Coral Gables, Florida 33134 Dear Dr. Blitstein: We are in receipt of your affidavit regarding Grove Isle, Ltd, Based on this.affidavit, it is the Department of Natural Resources' position that the Grove Isle marina is not a com- mercial income producing marina. Therefore no lease is re- quired from the Department, as long as the marina is in compliance with the terms and conditions set forth in the affidavit. erCWq 0lKIM - - October 8, '1979 Honorable Lawton Chiles United States Senate Federal Building Lakeland, Florida 33801 Dear Senator Chiles: Thank you for your letter received September 17, 19791 regarding the proposed Grove Isle Marina. An attorney from our office reviewed the Grove Isle Marina file with Mr. David Doheny. The issue raised by Mr. Doheny and several other concerned citizens residing near the project was whether the proposed marina was a private docking facility or a commercial docking facility which would require a lease from the Trustees pursuant to Chapter 253.03, F.S. and Chapter 16C-12.14(1), F.A.C. The determinative factor is whether the proposed marina will produce direct income. It is the Department of Natural Resources policy that where a marina is part of a condominium development, and the marina slips will be provided to individual condominium purchasers, the marina is not considered income producing for purposes of Chapter 16C-12.14, F.A.C. Conversely, where marina boat slips will be sold or leased to the public regardless of condominium ownership, the marina would be considered income producing, and would require a lease from r the Trustees. Initially, the Grove Isle Marina developer indicated to the Department of Natural Resources that the proposed marina would be solely part of the Grove Isle condominium development. We have since received information from Mr. Doheny, and others, indicating that boat slips would be made available to purchasers or lessees not residing at the condominium development. The appli- cant and the Department of Environmental Regulation have both been advised that based on the materials submitted by the applicant, this facility is a private dock for use by the condominium dwellers on Grove isle. Rule No. 16C-12.01, Florida Administrative Code, defines commercial docks as "a structure located on or over sovereignty lands used to produce.direct income".
