HomeMy WebLinkAboutO-09079LCD/smc AMENDMENT NO. 11 TO ORDINANCE NO. 9000 3/11/80 2bC ORDINANCE NO. 9079 AN ORDINANCE AMENDING SECTIONS 1 AND 5 OF ORDINANCE NO. 9000, ADOPTED OCTOBER 17, 1979, THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEI4BER 30, 1980, AS AMENDED; BY INCREASING THE APPROPRIATION FOR THE GENERAL FUND, SPECIAL PROGRAMS AND ACCOUNTS, BY $95,075, CONSISTING OF $45,075 FOR CERTAIN QUALITY OF LIFE PROGRAMS AND $509000 FOR EXTERNAL AUDITING FEES; BY INCREASING THE APPROPRIATION FOR THE LAW DEPARTMENT BY $25,000 FOR A SPECIAL MUNICIPAL PROSECUTOR; AND BY INCREASING ANTICIPATED GENERAL FUND REVENUES, LICENSES AND PERMITS, BY $120,075 FOR THE AFOREMENTIONED PURPOSES; CON- TAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND DISPENSING WITH THE REQUIREMENT OF READING SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION. WHEREAS, the City Commission adopted Ordinance No. 9000 on October 17, 1979, establishing revenues and appropriations for the City of Miami, Florida, for the fiscal year ending September 30, 1980; and WHEREAS, the City Commission approved funding for the following Quality of Life Programs at the February 28, 1980, meeting: - FY'80 Funds Authorizing Adopted Approved Additional Program Legislation Budget 2 28 80 Requirement Chopin Competition M. 80-137 $ -0- $10,000 $10,000 St. Patrick's Day R. 80-142 -0- 10,000 10,000 International Folk Festival Ord. 9072 15,705 34,705 19,000 Children's Theater Perform-a-thon M. 80-133 2,000 7,500 5,500 Little Havana Kiwanis Club R. 80-155 4,500 5,075 575 Totals $22,295 $67,280 $45,075 WHEREAS, the requirement of $45,075 will provide funding for two (2) new programs in the amount of $20,000 and additional funding for three (3) existing programs in the amount of $25,075; and WHEREAS, the adopted FY'80 Budget provides the amount of $80,000 for External Auditing Fees and an additional $500000 is required to increase the appropriations to $130,000; and WHEREAS, the City Attorney and the State Attorney for the Eleventh Judicial Circuit have agreed that it is in the best interest of the admini- stration of justice and of the citizens of the City to have a Special Municipal Prosecutor appointed (a) to handle prosecution of those charged with violation of the city code of ordinances and (b) to closely monitor the prosecution of prostitution -type offenses; and WHEREAS, a similar situation of such close coordination and sup- port may be seen in the relationship that exists between the City of Orlando and Orange County, Florida, pursuant to the provisions of Florida Statutes, Section 27.34; and WHEREAS, the Special I•lunicipal Prosecutor will have as his sole duty the responsibility to prosecute those charged with violations of the Miami Code or Ordinances and will be located in this office and work under the supervision of the City Attorney; and WHEREAS, an amount of $25,000 will be required for the salary and support costs of such Special Municipal Prosecutor; and WHEREAS, an amount of $120,075 in increased anticipated revenues, consisting of $114,000 from Building Permits and $6,075 from Electrical Inspections, is available and can be used to provide funding for the above mentioned actions; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Sections 1 and 5 of Ordinance No. 9000, adopted October 17, 1979, the Annual Appropriations Ordinance for the fiscal year ending September 30, 1980, as amended, are hereby further amended in the following particulars:!/ "Section 1. The following appropriations are made for the municipal operations of the City of Miami, Florida, for the fiscal year 1979-80 including the payment of principal and interest on all General Obligation Bonds: ?� Words and/or figures stricken through shall be deleted. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provis- ions of this ordinance shall not be affected. Section 5. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. The Adopted FY'80 Budget provided the amount of $80,000 for External Auditing Fees. It is a,)ticipated that an additional $50,000 will be required to increase the approp- riation to $130,000. Pursuant to a meeting between Gerardo Salman, Director, Building and Zoning Inspection, and a subsequent agreement between the City Attorney and the State Attorney, an amount of $25,000 will be required for the salaries and support costs of a Special Assistant State Attorney who will be stationed in the Law Department in order to file, present, and expedite court cases. All of the above requirements total $120,075 and the Department of Building and Zoning Inspection has identified additional revenues from Building Permits ($114,000) and Electrical Inspections ($6,075) to meet this need. The attached proposed ordinance appropriates $25,000 into the General Fund, Law Department to provide for a Special Assistant State Attorney and $95,075 into Special Programs and Accounts to provide an additional $50,000 for External Auditing Fees and $45,075 for community programs.
