AN ORDINANCE REPEALING SECTION 39-6
OF THE CODE OF THE CITY OF MIAMI, FLORIDA,
AS AMENDED, IN ITS ENTIRETY, WHICH PERTAINS
TO PROCEDURES AND USE CHARGES AT THE MUNICI-
PAL AUDITORUM AND COCONUT GROVE EXHIBITION
CENTER AND SUBSTITUTING THEREFOR A NEW SEC-
TION 39-6 REQUIRING PROSPECTIVE USERS TO
PAY A CASH RESERVATION DEPOSIT EQUAL TO 20%
OF THE BASIC USE FEE WITHIN 10 WORKING DAYS
FROM THE DATE OF BEING SENT CONFIRMATION
THAT A RESERVATION OF DATE(S) HAS BEEN MADE;
ESTABLISHING A 50% ADVANCE PAYMENT REQUIRE-
MENT WITH A FOREFEITURE PROVISION; INCREAS-
ING SPECIFIED FEES FOR USE OF VARIOUS AREAS
WITHIN THE AUDITORIUMS AND FURTHER INCREASING
CERTAIN SPECIFIED FEES DETERMINED BY THE TYPE
OF EVENT BEING HELD; ESTABLISHING SETUP COSTS
FOR LABOR AND MOVE -IN AND MOVE -OUT FEES;
CONTAINING A REPEALER PROVISION AND A SEVER -
ABILITY CLAUSE AND DISPENSING WITH THE REQUIRE-
MENT OF READING SAME ON TWO SEPARATE DAYS BY
A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE
MEMBERS OF THE COMMISSION.
WHEREAS, a review of City auditorium rate structure and
schedule reflects that an increase in rates is necessary to
reduce the huge operating deficit which has resulted from
large fixed -operation costs and spiraling inflation;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Section 39-6 of the Code of the City of
Miami, Florida, as amended, is hereby repealed in its
entirety and the following is hereby substituted in its
place and stead:
- "Sec. 39-6. City Auditoriums --use rates and reservation
requirements, setup costs, move -in and
move -out charges.
(a) Unless otherwise indicated, all of the following
provisions apply to both the Municipal Auditorium and to
the Coconut Grove Exhibition Center (formerly known as
Dinner Key Recreation Center/Exhibition Hall).

(1) Use rates include normal janitorial service,
showtime airconditioning, normal house lights and such other
items of available equipment as may be necessary for the
presentation of an event.
(2) Use rates do not include event personnel,
policemen, firemen, security guards, ushering staff,
ticket sellers and ticket takers, stagehands, spotlight
operators, musicians, projectionists, booth equipment,
installing and dismantling electrical installation(s),
setup of tables and chairs and portable stages.
(3) Use rates are applicable to a day or
fraction thereof.
(4) (1) Persons or, organizations wishing to
use the said facilities shall be required to pay an amount
equal to 20% of basic use fee as a cash reservation deposit
within 10 working days from the date of notification being
sent by the city, that a date(s) has been reserved; if
this payment is not timely made, the reservation of
date(s) shall be considered null and void.
(ii) User must pay to city for use of said
facilities the remaining 30% of a minimum 50% of the basic
use fee no later than 30 days prior to moving into the
premises.
(iii) Unless otherwise governed by written
agreement, payment of the remaining 50% of the basic
use fee shall be paid before opening of the event, and
must be made in cash or by cashier's check from a domestic
bank.

(5) The monies paid to the city under subsections
(4)(i) and (ii) hereof will be forefeit if user cancels the
event any time after the payment of monies under each such
subsection.
(6)(a) User shall have no right to transfer or
assign any interest whatsoever in the city's agreement per-
mitting use of said facilities unless such right shall have
been provided for within said agreement of the city.
(b) MUNICIPAL AUDITORIUM USE RATE SCHEDULE:
(1) Trade show, exhibitions, consumer shows:
a. Caribbean Room .... $850 per
day flat.
b. Gulfstream Room.. $750 per
day flat.
(2) Public admission events:
a. Caribbean Room....$800 per
day flat.
b. Gulfstream Room...$700 per
day flat.
(3) Noncommercial, nonprofit:
a. Carribean Room .... $750 per
day flat.
b. Gulfstream Room ... $650 per
day flat.
(c) COCONUT GROVE EXHIBITION CENTER USE RATE
SCHEDULE:
(1) Trade shows, exhibitions, consumer shows:
a. Main Hall and West Exhibit Area
(i) Three day scheduled show or less

southside of the Exhibition Center
and Biscayne ....$200 per day flat.
(2) PUBLIC ADMISSION EVENTS:
a. Main Hall and West Exhibit Area
........$2,000 or 10% of ticket sales,
after taxes, whichever is greater.
b. Main Hall
........$1,500 or 10% of ticket sales,
after taxes, whichever is greater.

c. West Exhibit Area
.....$600 or 10% of ticket sales,
after taxes, whichever is greater.
d. Mezzanine
.....$400 or 10% of ticket sales,
after taxes, whichever is greater.
e. Courtyard
.....$500 or 10% of ticket sales,
after taxes, whichever is greater.
(3) NONCOMMERCIAL, NONPROFIT:
a. Main Hail .........$1,200 per day flat.
b. West Exhibit Area..$600 per day flat.
c. Mezzanine .......... $350 per day flat.
d. Courtyard .......... $400 per day flat.
(d) MOVE -IN OR MOVE -OUT:
(1) For Shows, Exhibits and Conventions one to
three days in duration: 2 days move -in and
2 days move -out at
no additional charge
(See NOTE).
(2) For Shows, Exhibits and Conventions four or
more days in duration: 4 days move -in and
3 days move -out at
no additional charge
(See NOTE).
NOTE: Any additional time required is at
the rate of one-half day rental fee
per day.
(e) SETUP COSTS FOR LABOR:
(1) Chairs.......... 1U each.
(2) Upholstered chairs if available
.....25t each.
- (3) Tables .......... 5od each.
(4) Portable Stage..$10 per section."
Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase or word of this ordinance is declared invalid,
the remaining provisions of this ordinance shall not be affected.

Section 5. The requirement of reading this ordinance
on two separate days is hereby dispensed with by a vote of
not less than four -fifths of the members of the Commission.

Attachments
It is recommended that an Ordinance be adopted which
would enable the Department of Stadiums and Marinas to
increase the non-refundable reservation fee to 20% of the .
basic rental for perspective users of city -owned auditoriums
and, further, that rental rates be increased for the municipal
auditorium at the level of $200.00 across the board.
With spiraling inflation, large fixed operation costs,
and deficits averaging $14,000 per month during the first
quarter, rate increases are essential in order that our
financial losses are not at an inordinate level at the end
of the fiscal year.
In essence, we are respectfully requesting the following:
1. Increase of the non-refundable reservation fee from
10% to 20".
2. A $200 across the board rental rate increase at the
Municipal Auditorium.
3. The establishment of a $200 per day rental fee for
use of the Promenade Area at the Coconut Grove
Exhibition Center.
The Department of Stadiums and Marinas recommends the
adoption of the enclosed Ordinance.
