AN ORDINANCE AMENDING CHAPTER 2 OF THE CODE OF
THE CITY OF MIAMI, FLORIDA, ENTITLED: "ADMINIS-
TRATION", BY AMENDING ARTICLE IV THEREOF, ENTITLED:
"DEPARTMENTS", BY REPEALING THEREFROM DIVISION 9,
ENTITLED: "DEPARTMENT OF PARKS AND RECREATION",
CONSISTING OF SECTIONS 2-56 THROUGH 2-60, AND SUB-
STITUTING A NEW DIVISION 9. CONSISTING OF THE SAME
ENUMERATED SECTIONS ESTABLISHING THE "DEPARTMENT OF
PARKS"; PROVIDING FOR THE APPOINTMENT OF A DIRECTOR
BY THE CITY MANAGER; PRESCRIBING THE FUNCTIONS AND
DUTIES OF THE DEPARTMENT; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
BE IT ORDAINED BY TH& COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. Article IV entitled "Departments" of Chap-
ter 2 entitled "Administration", of the Code of the City of
Miami, Florida, as amended, is hereby further amended by the
repeal of Division 9, entitled "Department of Parks and Recrea-
tion", and the following is substituted in its place and stead:
i "Chapter 2. Administration
_ Article IV. Departments
DIVISION 9. DEPARTMENT OF PARKS.
Sec. 2-56. Created.
There is hereby created a department to be known
as the department of parks.
- Sec. 2-57. Director of Parks --Head of department.
The head of the department of parks shall be known
as the director of parks.
Sec. 2-58. Same --Appointment.
The city manager is hereby authorized to appoint
the director of parks.
Sec. 2-59. Same --Supervision and control of department.
The director of parks shall be subject to the super-
vision and control of the city manager in all matters,
and shall administer the affairs of the department of
parks.
Sec. 2-60. Functions of department.
The functions and duties of the department of parks
shall include:
(a) development, maintenance, management and super-
vision of the operations of city parks and cemetery.
(b)(i) coordination of the development, planning,
design and construction of parks.
(ii) management of all maintenance, design and
construction efforts involving city golf courses.
(iii) maintenance of a close relationship with
the department of leisure services concerning design,
use and maintenance of all park facilities.
(c) such other duties as may be provided by ordi-
nance; and the enforcement of all laws, ordinances
and regulations relative to the above powers and
duties."
Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase, or word of this ordinance is declared invalid,
the remaining provisions of this ordinance shall not be affected.

It is recommended that an ordinance be passed
creating a new Department of Parks inasmuch as
no legislation has ever been passed to formally
creat,. a Department of Parks and to identify
its functions.
The Det)ar.tr:�nnt of Parks has never been established as a separate entity
and has been functioning unofficially as the "Parks Department;" an
administrative modification of the Department of Parks and Recreation.
